ABSTRAK Tesis ini membahas tentang terjadinya liberalisasi migas dan melemahnya perannegara dalam penguasaan energi strategis dengan mengambil studi kasuspenguasaan operatorship di blok cepu pada tahun 2006. Undang-Undang No 22tahun 2001 menjadi simbol terjadinya liberalisasi di sektor migas, hal inimerupakan kelanjutan proses liberalisasi yang masuk melalui kesepakatankesepakatanletter of intent. IMF. Regulasi baru ini merubah penempatan kuasapertambangan yang semula dipegang oleh BUMN strategis di sektor migas yaituPertamina yang kemudian diserahkan langsung kepada Pemerintah. PosisiPertamina yang dulunya merangkap sebagai pemain dan regulator dipisahkanserta operasinya di unbundling. Regulasi yang baru juga memproduksi institusibaru yaitu BP Migas di sektor hulu dan BPH Migas di sektor hilir yang bertugassebagai pengawas dan manajer di masing-masing sektor. Liberalnya iklim migasmembawa pelemahan terhadap peran negara khususnya pada penguasan energi,padahal disaat yang bersamaan kebutuhan energi migas semakin besar dan negaramenempatkan dirinya pada posisi yang rentan dalam pemenuhan energi di dalamnegeriPenelitian ini merupakan penelitian kualitatif dengan metode studi kasus. Hasilpenelitian memperlihatkan energi strategis dalam hal ini minyak dan gas tidak lagidipandang sebagai sebuah modal pembangunan namun sekedar komoditas semata.Sehingga ketika perspektif komoditas yang dijadikan ukuran maka pendekatanmarket yang digunakan oleh Pemerintah. Penguasaan operatorship Blok Cepuyang dimenangkan oleh ExxonMobil dan bukan oleh Pertamina menjadi faktanyata bahwa sektor migas mengalami liberalisasi. Pertamina sebagai BUMNstrategis tidak mendapatkan dukungan dan kepercayaan dari Pemerintah dalampengelolaan Blok Cepu, negara telah melemahkan perannya dalam penguasaanenergi strategis. ABSTRACT This thesis discusses the liberalization of oil and gas and weakening the state'srole in the strategic energy control by taking control of the case studiesoperatorship in Cepu block in 2006. Act No. 22 of 2001 became a symbol of theliberalization in the oil and gas sector, it is a continuing process of liberalizationthat goes through agreements IMF letter of intent. This new regulation change theplacement of mining rights previously held by strategic state-owned oil and gassector Pertamina which is then submitted directly to the Government. Pertaminaposition formerly doubled as a player and regulator are separated as well asoperations in unbundling. The new regulation also produce new institutions thatBP Migas in the upstream and downstream sectors of BPH Migas, who served assupervisors and managers in each sector. Liberal climate of the oil and gas tobring the weakening role of the state in particular on energy brushes, but at thesame time the larger oil and gas energy needs and the state put himself in avulnerable position in the domestic energy needsThis research is a qualitative case study method. The results showed in thisstrategic energy oil and gas are no longer viewed as a mere commodity but ascapital development. So when perspective is used as measure of the commodity,market approach used by the Government. Operatorship of the Cepu BlockMastery won by ExxonMobil and not by Pertamina became obvious fact that theoil and gas sector experienced liberalization. Pertamina as a strategic state-ownedenterprises do not have the support and confidence from the Government in themanagement of the Cepu Block, the state has weakened its role in the strategicenergy control. |
