 Abstract
Notaris adalah pejabat publik yang berperan melayani masyarakat dalam hal kepengurusan akta dan dokumen legal. Atas jasanya tersebut notaris berhak mendapatkan honorarium. Namun pasal 37 Undang - Undang Jabatan Notaris (UUJN) mewajibkan notaris memberikan pelayanan jasa tanpa biaya kepada masyarakat kurang mampu. Penelitian ini bertujuan untuk mengidentifikasi peran dan tanggung jawab seorang notaris dalam memberikan pelayanan sosial kepada masyarakat dan mengamati penerapan pelayanan sosial tersebut sebagaimana diatur dalam perundang-undangan. Metode penelitian adalah normatif-empiris yang berfokus kepada kajian terhadap norma-norma dalam hukum positif serta memberikan kuisioner dan wawancara kepada narasumber. Dari penelitian yang dilakukan disimpulkan bahwa kewajiban serta tanggung jawab notaris dalam memberikan pelayanan bebas biaya kepada masyarakat kurang mampu belum optimal. ......Notary is a public official who is licensed to serve the community in the management of any legal documents. For his services notary may obtain income by charging fees. However, article 37 of Undang - Undang Jabatan Notaris (UUJN) stated it is mandatory for a notary to provide free social services to the underprivileged. This study aimed to identify the role and social responsibility of a public notary in community and observe the application this role as stipulated in the act. The research method is normative empirical that focusing on the norms of positive law by conducting questionnaries and interviews. From research conducted, it can be concluded that the notary role and responsibility in providing free social services for the underprivileged is not optimal.
