Kepemilikan bangunan gedung bertingkat dalam bentuk apartemen/kondominium oleh warga negara asing di Indonesia semakin meningkat setiap tahunnya seiring dengan masuknya investasi asing untuk meningkatkan perekonomian negara. Ketentuan hukum yang mengatur tentang hunian untuk warga negara asing yang berkedudukan di Indonesia dalam bentuk rumah tinggal ataupun satuan rumah susun di atas tanah Hak Pakai dalam perkembangannya di dunia properti mengalami beberapa pergeseran. Bangunan gedung bertingkat dalam bentuk apartemen/kondominium didirikan oleh para pengembang di atas tanah dengan status Hak Guna Bangunan. Undang-Undang Rumah Susun hadir untuk memperkenalkan lembaga baru yaitu Hak Milik atas Satuan Rumah Susun.Hadirnya tesis ini diharapkan dapat membantu pembaca untuk memahami konsep kepemilikan rumah susun dalam bentuk apartemen/kondominium oleh warga negara asing di atas sebidang tanah berdasarkan ketentuan hukum pertanahan di Indonesia.Dalam tesis ini tidak hanya pengertian teoretis yang disajikan, tetapi disampaikan juga kasus yang terjadi dalam praktek di masyarakat khususnya pada sektor properti dengan analisa solusi dari penulis. Dengan segala keterbatasan yang ada, penulis telah berupaya secara maksimal untuk menyajikan semua fakta, data serta analisa dalam penjabaran tesis ini, sehingga diharapkan setelah membaca tesis ini, pembaca akan mengerti bagaimana aturan hukum yang tepat bagi warga negara asing jika hendak memiliki rumah susun di Indonesia dalam bentuk apartemen/kondominium. ABSTRACT Ownership-rise buildings in the form of apartments / condominiums by foreigners in Indonesia has increased each year in line with the influx of foreign investment to boost the country's economy. Legal provisions governing occupancy for foreigners domiciled in Indonesia in the form of houses or apartment units on the ground Right to Use in its development in the real estate experience some shifts. Storey buildings in the form of an apartment / condominium established by the developers on the ground with the statusBroking. Flats Act exists to introduce new institutions, namely the Unit Ownership Flats.The presence of this thesis is expected to help the reader to understand the concept of ownership flats in the form of apartments / condominiums by foreigners in the land under the provisions of the land law in Indonesia. In this thesis not only presented a theoretical sense, but also presented examples of cases that have occurred in practice in the community, especially in the property sector with the analytical solution of the author.With all its limitations, the authors have attempted to present to the maximum allthe facts, data and analysis in the elaboration of this thesis, so hopefully after readingthis thesis, readers will understand how ownership flats in the form of apartment / condo by citizens on a piece of land |
