Abstract
Skripsi ini membahas tentang kekuatan mengikat perjanjian pengikatan jual beli yang digunakan sebagai instrumen penyelundupan hukum dalam kegiatan penjualan tanah kaveling yang dilakukan oleh developer perumahan dalam rangka lingkungan siap bangun. Penelitian ini adalah penelitian kualitatif dengan pendekatan peraturan perundang-undangan.
Hasil penelitian menyimpulkan bahwa perjanjian pengikatan jual beli yang digunakan sebagai instrumen penyelundupan hukum dalam kegiatan penjualan tanah kaveling, merupakan penyelundupan hukum oleh karenanya tidak memenuhi syarat sahnya perjanjian sehingga batal demi hukum dan tidak memiliki kekuatan mengikat. Oleh sebab itu perjanjian pengikatan jual beli yang digunakan sebagai instrumen penyelundupan hukum dalam kegiatan penjualan tanah kaveling adalah disarankan untuk tidak dibuat.
This thesis is reviewing about the legal binding of sale/purchase agreement which is used by developers as law evasion to sell land lot in order of development-ready neighbourhood. This research is a qualitative research with statute approach. This reseach result concludes that sale/purchase agreement which is used by developers as law evasion to sell land lot is a law evasion, so it does not meet the legal requirement. Therefore it is null and void, and not legally binding. For that reason, sale/purchase agreement which is used by developers as law evasion to sell land lot is suggested as not to be made.
