Abstract
Penelitian ini bertujuan untuk mengetahui peraturan mana yang tepat untuk diterapkan, antara UUJF dan UUKPKPU, dalam pelaksanaan eksekusi terhadap boedel pailit, mengingat keduanya memiliki ketentuan yang saling bertentangan, dan untuk mengetahui urutan kreditor dalam pembagian hasil boedel pailit. Berdasarkan penelitian ini, ditemukan bahwa asas Systematische Specialiteit dapat digunakan untuk menentukan peraturan mana yang harus diterapkan, dan juga urutan kreditor dalam pembagian hasil boedel pailit, namun belum ada pengaturan yang jelas mengenai kedua hal tersebut, sehingga belum ada kepastian hukum, karena hakim dapat memiliki penafsiran yang berbeda dalam menentukan peraturan yang akan diterapkan, dan akibatnya putusan yang terbit juga berbeda.
This research is purposed on knowing which regulations are suitable to be implemented; between "UUJF" and "UUKPKPU", in executing the bankruptcy estate, despite the contraries in those regulations, and to define the priority of creditors on the estates? execution. Based on the research, Systematische Specialiteit can be used to which regulation is suitable, and also reveal the suitable priority of the creditors on the estates? execution. However, the law couldn?t regulate them precisely, so the supremacy of law won?t be established because Judges are having different interpretation on implementing the law. Therefore, there?ll be different decision in bankruptcy cases.
