Pada tahun 1997 Pemerintah DKI Jakarta mengeluarkan Surat Keputusan Gubernur terkait dengan penyedian tanah untuk rumah susun yaitu Surat Keputusan No. 122 tahun 1997. hal ini menjadi permasalahan, terutama warga masyarakat yang telah memiliki sertipikat yaitu Bagaimanakah kekuatan Sertipikat Hak Guna Bangunan Nomor 54/Petamburan terkait dengan adanya Surat Keputusan Gubernur DKI Jakarta No. 122 tahun 1997 ? Bagaimanakah perlindungan hukum yang dapat diberikan kepada pemegang bekas Hak Guna Bangunan Nomor 54/Petamburan sehubungan dengan diberlakukannya Surat Keputusan Gubernur DKI Jakarta No. 122 tahun 1997 ? Apakah Surat Keputusan Gubernur Kepala Daerah Khusus Ibu Kota Jakarta No. 122 tahun 1997 telah sesuai dengan peraturan perundang-undangan yang berlaku ? Bentuk Penelitian dalam penulisan ini adalah yuridis normatif. Yuridis normatif adalah melakukan analisa masalah berdasarkan penelusuran kepustakaan (peraturan perundang-undangan, buku-buku, literatur dan lain-lain), yang berhubungan dengan permasalahan perpanjangan Sertipikat Hak Guna Bangunan No. 54/Petamburan dan mewawancarai narasumber yang terkait, Jenis data yang digunakan dalam penelitian ini adalah data primer dan data sekunder.Dengan tidak dilanjutkannya proyek rumah susun ini dan/atau tidak dicabutnya Surat Keputusan Gubernur DKI Jakarta No. 122 Tahun 1997 menimbulkan Ketidak pastian hokum bekas Hak Guna Bangunan No. 54/ Petamburan, tidak adanya perlindungan hukum bagi pemilik tanah bekas Hak Guna Bangunan No. 54/petamburan yang diberikan oleh Negara dalam hal ini Pemerintah DKI Jakarta. Kekuatan hukum sertipikat Hak Guna Bangunan No. 54/Petamburan tetap kuat selama tidak ada yang dapat membuktikan sebaliknya, tetapi jika jangka waktu Hak Guna Bangunan sudah berakhir kekuatan alat bukti sudah tidak ada lagi, sehubungan dengan itu jika dikaitkan dengan Surat Keputusan Gubernur No. 122 tahun 1997 yang ditetapkan pada tanggal 23 Januari 1997, apabila Hak Guna Bangunan telah berakhir perpanjangan Hak Guna Bangunan tersebut tidak dapat dilakukan karena terkena ketentuan Surat Keputusan Gubernur No. 122 tahun 1997 tentang Penetapan penguasaan bidang tanah seluas + 23 ha untuk Pembangunan Rumah Susun Murah dan Fasilitasnya di Kelurahan Petamburan Kecamatan Tanah Abang, Kotamadya Jakarta Pusat, sehingga kekuatan hukum bagi pemilik bekas Hak Guna Bangunan No. 54/Petamburan adalah hanya secara fisik yaitu sampai saat ini rumah yang berdiri diatas tanah bekas Hak Guna Bangunan No. 54/Petamburan masih ditempati dan dikuasai oleh ahli waris Almarhumah Chadijah Seger.
