Abstract
ABSTRAK
Dalam hal terjadinya perwarisan, ahli waris tidak hanya mendapatkan hak atas kekayaan, akan tetapi juga kewajiban terhadap utang-utang dan beban-beban lain yang diakibatkan oleh perbuatan pewaris, termasuk di dalamnya kerugian akibat dari Perbuatan Melawan Hukum. Salah satu contohnya adalah pada putusan nomor 02/PDT.G/2010/PN.DPK, dimana Alm. Yusuf Setiawan selaku Direktur PT. Setiajaya Mobilindo didakwa melakukan korupsi dan meninggal pada saat persidangan. Kemudian gugatan perdata dilanjutkan kepada para ahli warisnya. Penelitian ini dilakukan secara normatif. Hasil dari penelitian ini adalah bahwa ahli waris bertanggung jawab atas akibat dari perbuatan melawan hukum yang dilakukan oleh pewaris (Alm. Yusuf Setiawan) yang berupa gugatan ganti kerugian, sedangkan perihal perbuatan melawan hukum itu sendiri tidak dapat dibebankan kepada para ahli waris.
ABSTRACT
In the case of inheritance, heiress not only get the right of property, but also an obligation to the debts and other expenses caused by the act of heir, including losses resulting from trot. One example is verdict No. 02/PDT.G/2010/PN.DPK, where Alm. Yusuf Setiawan as Director of Setiajaya Mobilindo LLC, charged with corruption and died during the trial. Then the civil suit, sued to the heiress. This research was conducted normative. Results from this study is that the heiress are responsible for the consequences of illegal actions carried out by the heir (Alm. Yusuf Setiawan) in the form of tort, while regarding tort itself cannot be passed on to the heiress.
