ABSTRAK Analisis yang dilakukan dalam penulisan ini adalah sengketa tanah yang terletak di Belawan,Medan, Sumatera Utara, antara M. Hafizham melawan PT. Pelabuhan Indonesia I (Persero) danKepala Kantor Pertanahan Kota Medan terkait eksistensi Hak Grant Sultan No. 1709 Tahun1917 yang berada dalam Hak Pengelolaan No.1/Belawan I. Analisis ini mengkaji PutusanPengadilan Negeri Medan Nomor: 561/Pdt.G.Int/2011/PN.MDN yang diputuskan pada tanggal5 Juni 2012 yang pada pokoknya mengabulkan gugatan penggugat untuk sebagian. Selain itu,oleh karena PT. Pelabuhan Indonesia I (Persero) mengajukan banding atas putusan PengadilanNegeri Medan tersebut, maka analisis ini juga mengkaji Putusan Pengadilan Tinggi MedanNomor: 375/PDT/2012/PT.MDN yang diputuskan pada tanggal 5 Juni 2013, yang padapokoknya membatalkan Putusan Pengadilan Negeri Nomor: 561/Pdt.G.Int/2011/PN.MDNkarena Judex Factie telah melanggar Hukum Acara Perdata, memutus melebihi kewenangannya,salah dan keliru mengenai dasar kepemilikan atas tanah Grant Sultan No. 1709 Tahun 1917, dantelah salah mengenai penyalahgunaan keadaan (Misbruik van Omstandigheden). Dalam analisispenulisan ini, terdapat tiga pokok permasalahan yang akan dibahas, yaitu pertama mengenaipengaturan dan pengaplikasian konversi tanah Grant Sultan, kedua mengenai status kepemilikantanah Grant Sultan No. 1709 Tahun 1917 dan ketiga mengenai eksistensi tanah Grant Sultan No.1709 Tahun 1917. Untuk menjawab ketiga pokok permasalahan tersebut, metode penelitianyang digunakan adalah metode penelitian hukum normatif atau metode penelitian kepustakaan(library research) khususnya mengenai sejarah dan pengaturan Grant Sultan Kesultanan Deli diSumatera Utara, baik sebelum maupun sesudah berlakunya Undang-Undang No. 5 Tahun 1960.Sumber dari subjek penelitian adalah bahan hukum primer yaitu peraturan perundang-undangandan Putusan Pengadilan Negeri Medan No 561/PDT.G.Int/2011/PN-MDN serta PutusanPengadilan Tinggi Medan No 375/PDT/2012/PT.MDN. Bahan hukum sekunder yang digunakanadalah literatur/buku yang berkaitan dengan Hukum Agraria, Grant Sultan, Kesultanan Deli dankonversi hak atas tanah. Hasil analisis yang telah dilakukan dalam penelitian ini, pertama,mengenai pengaturan dan pengaplikasian konversi atas tanah Grant Sultan diatur dalamPeraturan Pemerintah Nomor 24 Tahun 1997 jo. Peraturan Menteri Negara Agraria/Kepala BPNNomor 3 Tahun 1997. Kedua, mengenai status kepemilikan tanah Grant Sultan No. 1709 Tahun1917 merupakan milik bersama (kolektif) Tengku Ibnu Maja Jafar, Tengku Muhammad Erfandan M. Hafizham. Ketiga, mengenai eksistensi tanah Grant Sultan No. 1709 Tahun 1917, baikMajelis Hakim Pengadilan Negeri maupun Majelis Hakim Pengadilan Tinggi, didalampertimbangannya mengakui eksistensi atau keberadaan tanah Grant Sultan No 1709 Tahun1917, walaupun menurut Majelis Hakim Pengadilan Tinggi, tanah Grant Sultan No. 1709 Tahun1917 letak dan batasnya tidak jelas. Solusi atas permasalahan tersebut adalah Pemerintahseharusnya segera mengambil langkah untuk mengatur secara jelas mengenai tanah-tanah hakadat ciptaan Pemerintah Swapraja termasuk cara dan syarat pendaftaran penegasan konversinya.Selanjutnya solusi yang dapat ditempuh bagi para pihak yang berperkara, oleh karena SuratGrant Sultan diterbitkan oleh Sultan Deli dan dicatat di Kantor Kesultanan, maka pihakKesultanan Deli-lah yang mengetahui baik mengenai keabsahan maupun mengenai letak danbatas atas tanah Grant Sultan No. 1709 Tahun 1917. Selain itu, harus ditelusuri apakah sejakditerbitkan Surat Grant Sultan No. 1709 Tahun 1917, pemiliknya telah memenuhi kewajibannyauntuk mengerjakan tanahnya atau tidak. ABSTRACT The analysis conducted in this thesis is a dispute of land that located in Belawan, Medan,North Sumatra, between M. Hafizham against PT. Pelabuhan Indonesia I (Persero) andHead of the Medan Land Office related to existence the rights of Grant Sultan Number 1709of 1917 which is in the HPL No.1/Belawan I. This analysis examines the decision of MedanDistrict Court Number: 561/Pdt.G.Int/2011/PN.MDN on June 5, 2012 which is principallygranted a partially plaintiff’s lawsuit. In addition, because of PT. Pelabuhan Indonesia I(Persero) appealed that decision of the Medan District Court, the analysis also examines thedecision of Medan High Court Number: 375/PDT/2012/PT.MDN on June 5, 2013, which isprincipally cancel the decision of Medan District Court Number:561/Pdt.G.Int/2011/PN.MDN, because Judex factie have violated the Procedure of CivilCode, decide exceeded its authority, wrong and mistaken in judging the basis of landownership of Grant Sultan Number 1709 of 1917, and has been wrong and mistaken injudging of undue influence (Misbruik van Omstandigheden). In the analysis of this thesis,there are three principal issues to be discussed, the first is the implementation andconversion of Grant Sultan land, the second is how the ownership status of Grant SultanNumber 1709 of 1917 land, the third is the existence of Grant Sultan Number 1709 of 1917.To answer those three basic problems, the research method that conducted is the normativelegal research method or library research methods, especially regarding the history andregulation of Grant Sultan on Deli Sultanate in North Sumatra both before and after theenactment of Law Number 5 of 1960. The sources of the subject research are the primarylegal materials that is Laws and Regulations, Medan District Court Decision Number561/PDT.G.Int/2011/PN-MDN and Medan High Court Decision Number375/PDT/2012/PT.MDN, and secondary legal material, are literature/books relating to theAgrarian Law, Grant Sultan, Sultanate of Deli and conversion of land rights. The first resultof the analysis that conducted in this study regarding the implementation and conversion theGrant Sultan rights is stipulated in Government Regulation Number 24 of 1997 jo. TheRegulation of Minister of Agrarian Affairs/Head of National Land Agency Number 3 of1997. The second result is the ownership status of the Grant Sultan Number 1709 of 1917,are the collectively property by Tengku Jafar Ibnu Maja, Tengku Muhammad Erfan and M.Hafizham. The third result, the existence of land Grant Sultan Number 1709 of 1917, boththe State Court Judge and High Court Judge, in his discretion does not deny the existence ofGrant Sultan land Number 1709 of 1917, even though according to the High Court Judge,the location and land boundaries of Grant Sultan Number 1709 of 1917 land are unclear. thesolution to these problems is, the Government should take steps to regulate the customaryland rights immediately including the terms and conditions of its conversion registration.Furthermore, the solution that can be reached by the parties is therefore Sultan Grant Letterissued by the Sultan of Deli and registered in the Sultanate, the Sultanate of Deli is the onewho knows both of validity, location and boundaries of Grant Sultan Number 1709 of 1917land. Furthermore, it should be traced whether since issued Letter of Grant Sultan Number1709 of 1917, the owner has fulfilled its obligation to utilize the land or not. |
