Musim 2007/2008 kesempatan penikmat Liga Utama Inggris mulai terbatas ketika televisi berbayar asal Malaysia ASTRO secara eksklusif membeli hak siar selama 3 tahun. Praktis pertandingan big match yang menghadirkan tim-tim besar tidak bisa dinikmati secara gratis lagi. Sehubungan dengan Hak Siar Ekslusif Liga Utama Inggris tersebut, Komisi Pengawas Persaingan Usaha menerima laporan mengenai adanya dugaan pelanggaran Pasal 16 Undang-undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat (Undang-undang No. 5 Tahun 1999) yang dilakukan oleh, Astro All Asia Networks, Plc (AAAN), dan PT. Direct Vision (PTDV), dengan ESPN STAR Sports (EES), dan Pasal 19 huruf a Undang-undang No. 5 Tahun 1999 yang dilakukan oleh AAAN dan PTDV. Berdasarkan Putusan KPPU ESS dan AAMN dinyatakan telah melanggar ketentuan Pasal 16 Undang-undang Nomor 5 Tahun 1999. Atas putusan tersebut PT. MNC Sky Vision (Indovision) selaku Pelapor pada KPPU, mengajukan upaya hukum keberatan pada Pengadilan Negeri Jakarta Barat, yang dalam putusannya menolak keberatan Indovision. Terhadap putusan Pengadilan Negeri Jakarta Barat tersebut, Indovision telah mengajukan kasasi pada Mahkamah Agung, yang dalam putusannya menguatkan putusan Pengadilan Negeri Jakarta Barat, Terhadap Putusan Mahkamah Agung tersebut, Indovision mengajukan Peninjauan Kembali kepada Mahkamah Agung yang dalam putusannya menguatkan putusan kasasi Mahkamah Agung. Tesis ini menggunakan penelitian yuridis normatif karena menitikberatkan pada penelitian kepustakaan yang intinya meneliti asas-asas hukum, sistematis hukum, dan sinkronisasi hukum dengan cara menganalisanya. Data yang diperoleh dianalisis dengan menggunakan metode deskriptif kualitatif. Selanjutnya, permasalahan yang dibahas dalam Tesis ini mengenai kesesuaian penerapan hukum dan perundang-undangan yang berlaku dalam Putusan KPPU, Pengadilan Negeri dan Putusan MA terkait Hak Siar Barclays Premier League (Liga Utama Inggris) musim 2007-2010. Berdasarkan hasil analisis diketahui bahwa pelanggaran yang dilakukan ESS dan AAMN terhadap unsur-unsur dalam Pasal 16 Undang-Undang Nomor 5 Tahun 1999 telah terpenuhi. Metode pendekatan yang digunakan dalam pembuktian adalah secara Rule Of Reason. Melalui analisis terhadap putusan tersebut diketahui bahwa Indovision selaku pelapor kepada KPPU tidak memiliki Legal Standing untuk mengajukan keberatan atas Putusan KPPU, selain itu KPPU, Pengadilan Negeri Jakarta Barat, serta Mahkamah Agung telah memberikan pertimbangan sesuai dengan ketentuan perundang-undangan yang berlaku.

Practically, Barclays Premier League?s big match that present the major teams was not free to air anymore. With regards to the exclusive broadcasting rights of Barclays Premier League, there is a report to The Commission for the supervision of Business Competition (KPPU) regarding alleged violations to Article 16 Law number 5 year 1999 about Anti Monopoly Practice and Unfair Business Competition (Law number 5 year 1999) performed by Astro All Asia Networks, Plc (AAAN), and PT. Direct Vision (PTDV), with ESPN STAR Sports (EES), and also alleged violations to Article 19 letter a Law number 5 year 1999 performed by AAAN and PTDV. Regarding the KPPU?s Decision, ESS and AAMN declared to have violated Article 16 Law number 5 year 1999. PT. MNC Sky Vision (Indovison) as a party who is reporting the allegation to KPPU, demurred against the KPPU?s Decision to the Distric Court of West Jakarta (Jakarta Barat), who has been decided to dismiss the demur. Indovision then appealed against the District Court Verdict to the Supreme Court, in which the Supreme Court is upheld the previous Verdict. Indovision then filed a judicial review against the Verdict, but again the Supremen Court is upheld the previous Verdict. This thesis uses normative legal research because it focuses on the research literature that examines the core principles of law, the law systematically, and the synchronization of the law in a way it analyzed. The data obtained were analyzed using qualitative descriptive methods. Furthermore, the problems will be discussed in this thesis is the suitability of the implementation of the prevailing laws and regulations in the Commission's Decisions, the District Court Decision, and Supreme Court related to Barclays Premier League Rights season 2007-2010. The results of analysis show that the violations committed by ESS and AAMN against the elements in Article 16 of Law No. 5 of 1999 have been fulfilled. The method used to proof the violations is Rule of Reason. Through analysis, Indovision does not have legal standing to demurred KPPU's Decisions, in addition to that, KPPU, the District Court of West Jakarta, and the Supreme Court have been implementing the Law in accordance with the prevailing Laws and regulations. |
