ABSTRAK Skripsi ini membahas tentang analisa putusan hakim yang menyatakan tergugattelah wanprestasi berdasarkan Putusan No. 267 PK/PDT/2011. Penelitian iniadalah penelitian kualitatif dengan desain deskriptif. Hasil penelitianmenyarankan agar hakim dalam putusannya menerapkan asas memuat dasaralasan yang jelas dan rinci; putusan yang dijatuhkan harus berdasarkanpertimbangan yang jelas dan cukup sebagaimana yang ditegaskan pada Pasal 25Ayat (1) UU No.4 Tahun 2004 tentang Kekuasaan Kehakiman dan Pasal 178 Ayat(1) HIR. ABSTRACT The focus of this study is the analysis of court decision that the defendant hasbeen declared in default by decision No. 267 PK/PDT/2011. The purpose of thisstudy is to understand if judges considerations of court decision No.397/Pdt.G/2006/PN.JKT.PST, court decision No. 24/PDT/2008/PT.DKI, courtdecision No. 56 K/Pdt/2009, and court decision No. 267 PK/PDT/2011 is right.This research is qualitative descriptive interpretive. The data were collected byliterature research. The researcher suggest that suggested that the judge in hisdecision to apply the principles contain a clear rationale and detailed; decisionhanded down should be based on clear and sufficient consideration as defined inArticle 25 Paragraph (1) of Act 4 of 2004 on Judicial Power and Article 178Paragraph (1 ) HIR. |
