Abstract
Tesis ini membahas kedudukan Negara dalam PSC Migas berkaitan telah berpindahnya hak dan kewajiban dari BP Migas ke SKK Migas. Pembahasannya dititik beratkan pada sampai sejauh mana tanggung jawab Negara dalam PSC. Untuk menjawabannya, penulis melakukan penelitian yuridis normatif dengan menggunakan data sekunder. Berkaitan dengan jenis peneilitian yuridis, penulis juga menggunakan peraturan yang terkait dengan migas. Akhirnya penulis mendapat kesimpulan bahwa setelah berpindah ke SKK Migas, kedudukan Negara berubah menjadi pihak dalam perjanjian. Perubahan ini membawa makna bahwa Negara bertanggung jawab sepenuhnya atas terlaksanakannya kewajiban dalam PSC.
......The focus of this study is the position of the state on Production Sharing Contract (PSC) of Oil and Gas related the transfer of rights and obligations from BP Migas to SKK Migas. The concern of this discussion is about the responsibility of the State on PSC. This is "yurudis normatif" research that uses secondary data and some regulations related migas. Finally, the conclusion of this discussion is that after the transfer, the position of the state has changed to be the party on the agreement. This change means that the State is fully responsible on every performance of obligations that is mentioned on the PSC.
