[ABSTRAK Tesis ini membahas mengenai proses penyelesaian perselisihanhubungan industrial khususnya dalam penyelesaian perselisihanPemutusan Hubungan Kerja (PHK) berdasarkan Putusan PeninjauanKembali Nomor 10 PK/Pdt.Sus/2013 yang melibatkan pekerja danPT. Pupuk Sriwidjaja (Persero) yang dianalisa berdasarkan UndangundangNomor 2 Tahun 2004 tentang Penyelesaian PerselisihanHubungan Industrial dan Undang-undang Nomor 13 Tahun 2003tentang Ketenagakerjaan. Penelitian ini merupakan penelitianyuridis normatif yang diharapkan dapat diperoleh aturan-aturanhukum yang mendasari pengambilan putusan penyelesaianperselisihan PHK. Para pihak yang berselisih, baik perusahaanmaupun pekerja harus menyelesaikan perselisihan sesuai denganprosedur penyelesaian perselisihan hubungan industrial yangberlaku berdasarkan peraturan perundang-undangan terkaitketenagakerjaan dan harus benar-benar memahami PeraturanPerundang-undangan ketenagakerjaan yang berlaku, isi peraturanperusahaan atau Perjanjian Kerja Bersama dan prinsip-prinsiphubungan industrial. ABSTRACT This thesis discusses the dispute resolution process in industrialrelations, particularly the dispute resolution of TerminationEmployment based on the Judgement on the Court JudgementReview No. 10/PK/Pdt.Sus/2013 involving employees and PT.Pupuk Sriwidjaja (Persero), which is analysed upon Act No. 2 Year2004 on Industrial Relations Dispute Settlement and Act No. 13Year 2003 on Manpower. This research is a legal -normativeresearch aiming to derive from the various acts the legal rulesserving as the foundation for reaching the Court Judgementconcerning Employment Termination dispute resolution.
