[Skripsi ini membahas mengenai perbedaan ketentuan UKM dalam hukum

persaingan yang diatur secara langsung di Indonesia UU No.5 Tahun 1999 dan

secara tidak langsung di Malaysia (Competition Act 2010). Untuk menganalisa

perbandingan kedua ketentuan hukum tersebut maka dalam hal ini, penulisan

dilakukan dengan metode pendekatan yuridis normatif. Pedoman Pasal 50 h UU

No.5/1999 tidak menentukan batasan yang spesifik terkait penerapan

pengecualian Usaha Kecil. Competition Act 2010 menyatakan sebaliknya,

ketentuan UKM tidak diatur secara langsung, Malaysia tidak memberikan

pengecualian kepada UKM, namun hal tersebut tidak berlaku secara mutlak.

Terdapat beberapa jenis perjanjian yang akan diijinkan untuk UKM karena

dianggap tidak mungkin memiliki efek anti-kompetitif atau tidak memiliki efek

signifikan dalam pasar. Selain itu skripsi ini juga akan menggambarkan dampak

kebijakan persaingan kepada UKM di kedua negara tersebut., This thesis defines analysis of differences provisions of SMEs in the

competition law which is regulated directly in Indonesia (UU no. 5 of 1999) and

indirectly in Malaysia (Competition Act 2010). Analyzing the differences of the

two provisions of SME’s taken using normative juridicial approach. Guidelines of

article 50 (h) UU No.5/1999 does not explain the specific restrictions related to

the application of the exemptions. Competition Act 2010 stated otherwise,

provisions of SME’s in Competition Law 2010 Malaysia is regulated indirectly

and Malaysia does not absolutely apply the competition law to SMEs. There are

several types of agreements that will be applicable for SMEs because they are

unlikely to have anti-competitive effects or do not have a significant effects on the

market. In addition, this thesis also describes the impact of competition policy to

SMEs in both countries.]
