ABSTRAK Skripsi ini membahas mengenai pertanggungjawaban perbuatan melawan hukum oleh pemerintah atas kerugian yang timbul akibat barang-barang yang berada dibawah pengawasannya, dimana pemerintah mempunyai kapasitas sebagai pemilik barang yang menimbulkan kerugian bagi orang lain. Ketentuan Pasal 1367 ayat (1) KUH Perdata mengharuskan seseorang bertanggung jawab ataskerugian yang disebabkan karena barang-barang yang berada dibawahpengawasannya (Vicarious Liability). Penelitian ini merupakan penelitian hukum yang membahas penerapan Pasal 1367 ayat (1) KUH Perdata kepada organ pemerintah yang kedudukannya berbeda dengan subjek hukum lain, dengan perolehan data melalui data sekunder berupa studi dokumen atau bahan kepustakaan. Dalam pengolahan data, metode yang digunakan adalah deskriptif analitis. ABSTRACT The focus of this study discussed the issue of accountability an unlawful act by the government for the loss resulting from goods under his watch, where the government has the capability to as the owner of goods which have inflicted losses from others. The provision of article 1367 paragraph (1) of Indonesia Civil Code requires someone responsible for the loss caused because of goods that are under their control (Vicarious Liability). This research is legal research to discussthe application of the provision of article 1367 paragraph (1) Indonesia Civil Code to government that his different to other legal subject, by the acquirement of data over the secondary data of the study documents or material literature. In data processing, the method is is applicable in descriptive analysis. |
