Tesis ini membahas mengenai hubungan Hukum Persaingan Usaha dengan Hak Siar dalam televisi dalam kaitannya dengan pengecualian dan batasan mengenai pengecualian dalam Pasal 50 huruf b Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli Dan Persaingan Usaha Tidak Sehat. Permasalahan pertama dalam Tesis ini Apakah Hak Siar dalam televisi termasuk kategori Hak atas Kekayaan Intelektual yang dikecualikan Pasal 50 huruf b UU Anti Monopoli? Permasalahan kedua, Bagaimana batasan mengenai hal-hal yang dapat dikecualikan berdasarkan Pasal 50 huruf b UU Anti Monopoli? Penelitian Tesis ini menggunakan penelitian normatif. Ditemukan bahwa Hak Siar melekat dalam Hak Terkait berupa Hak Penyiaran Lembaga Penyiaran. Bahwa penggunaan Hak Eksklusif dalam perjanjian lisensi Hak atas Kekayaan Intelektual tidak boleh menciptakan praktik monopoli yang dapat mengakibatkan persaingan usaha tidak sehat. Sebab itu pengecualian terhadap perjanjian lisensi Hak atas Kekayaan Intelektual tidak bersifat mutlak. Terdapat batas kewajaran dalam mengekploitasi Hak Eksklusif. Struktur pasar merupakan instrument utama yang dapat memperlihatkan sifat persaingan usaha tidak sehat yang ditimbulkan oleh perjanjian lisensi Hak atas Kekayaan Intelektual. This thesis discusses the relationship with the Competition Law in Television Broadcasting Right in relation to exceptions and limitations regarding the exclusion of Article 50 letter b of Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. The first problem in this thesis Is Television Broadcasting Right in the category of Intellectual Property Rights which excluded Article 50 Letter b of the Anti Monopoly Law? The second problem, How restrictions on matters that can be exempted under Article 50 letter b of the Anti Monopoly Law? This thesis is using normative research. Found that Broadcasting Right inherent in the form of Neighboring Right by Broadcasting Organization. That the execise of Exclusive Rights in the license agreement on Intellectual Property Rights may not create a monopoly practices that may result unfair competition. Related to the previous facts the exclusion to the license agreement on Intellectual Property Rights are not absolute. There are reasonable limits in exploiting Exclusive Rights. The market structure is the main instrument that can reveal the nature of unfair competition posed by the license agreement on Intellectual Property Rights. |
