ABSTRAK
Skripsi ini membahas mengenai sejarah dinamika hukum Australia terkait Aboriginal Land Rights. Skripsi ini mendiskusikan klaim seorang pemimpin Penduduk Kepulauan Sekat Torres yang terkemuka, Eddie Mabo, terhadap land rights. Di tahun 1982, Eddie Mabo dan empat kerabatnya menuntut Pemerintah Queensland atas legalitas hak mereka di tanah yang mereka huni. Untuk pertama kalinya dalam sejarah Australia, High Court memberikan land rights kepada orang-orang Aborigin. Kemenangan ini menjadi titik balik kebijakan Australia terkait penduduk asli dengan dikeluarkannya Native Title Act di tahun 1993. Penelitian ini didasarkan dari sumber arsip yang dimiliki oleh National Archives of Australia dan dokumen legal High Court of Australia juga surat kabar serta video dokumenter terkait Mabo. Skripsi ini diteliti menggunakan metode sejarah.
ABSTRACT
This study is focusing on the dynamics of Australian Law regarding Aboriginal Land Rights. It discusses the claim of Torres Strait Islander prominent leader, Eddie Mabo on his land rights. In 1982, Eddie Mabo and friends sued Queensland Government concerning their legal rights on their own land. For the first time in Australian history, High Court passed the Aboriginal Land Rights. This winning became a turning point on Australian policy towards the indigenous people by producing the Native Title Act in 1993. This research based on archival sources held in the National Archives of Australia and High Court legal documents as well as newspapers and documentary video on Mabo. This study based on historical methods.
