ABSTRAK Bank Mega selaku industri jasa keuangan menyediakan produk jasakeuangan berupa deposito dan hal tersebut dimanfaatkan oleh PT Elnusa Tbk.Namun, dana milik Elnusa tersebut disalahgunakan oleh keterlibatan oknumsehingga dana milik PT Elnusa Tbk menjadi hilang di Bank Mega. Bank Megakemudian membawa ke jalur hukum. Penulis menggunakan metode deskriptifdalam menganalisis pokok permasalahan. Skripsi ini akan membahas bagaimanaperlindungan nasabah pada Bank Mega yaitu PT Elnusa Tbk dimana dana yangdititipkan di Bank Mega telah hilang sehingga PT Elnusa Tbk tidak bisa diatrikdananya meskipun kasus ini dibawa hingga ke jalur pengadilan dan PT ElnusaTbk selaku nasabah menang hingga tingkat kasasi. Bank Mega wajibbertanggungjawab terhadap dana milik PT Elnusa Tbk dan bisa menggunakanberbagai skema dalam pembayaran kepada PT Elnusa Tbk ABSTRACT Bank Mega as the financial services industry provides financial services includedeposit and it was used by PT Elnusa Tbk. But, there are fraud which caused byinternal party and then Bank Mega cann’t withdraw its fund from Bank Mega.Bank Mega chose legal action to withdraw its fund. The writer choose descriptivemethod to analysis the problem. This paper will discuss how customer protectionin Bank Mega Tbk , PT Elnusa where the funds are deposited in Bank Mega haslost so PT Elnusa Tbk can not withdraw their funds so that the case was broughtto the court lines and PT Elnusa Tbk, the customer wins to appeal . This paperwill discuss how the use of an escrow account in the protection of customer fundsand efforts to attempt an alternative in the payment of customer funds belongingto PT Elnusa Tbk . Bank Mega is obliged to pay its fund based on court decisionand the procedure to transfer the fund to PT Elnusa Tbk as a customer can beexercised through various scheme. |
