[Akta jual beli seharusnya merupakan bukti bahwa benar telah dilakukan perbuatan hukum peralihan hak atas tanah untuk selama-lamanya bukan dilakukan dengan melanggar Undang-undang (Ongeoorloofde Oorzak). Pembuktian bahwa hak atas tanah tersebut dialihkan dibuktikan dengan suatu akta yang dibuat oleh dan dihadapan Pejabat Pembuat Akta Tanah. Permasalahan dalam tesis ini adalah bagaimana akibat hukum yang ditimbulkan oleh akta jual beli yang dilakukandengan mengandung sebab yang dilarang Undang-undang (Ongeoorloofde Oorzak) dalam Putusan nomor 1369 K/PDT/2013 dan bagaimana peran dan tanggung jawab Pejabat Pembuat Akta Tanah dengan adanya akta jual beli yang dilakukan dengan mengandung sebab yang dilarang Undang-undang (Oongeoorloofde Oorzak). Untuk menjawab permasalahan tersebut dilakukan penelitian hukum dengan pendekatan secara yuridis normatif, mempergunakan data sekunder yang diperoleh dari studi kepustakaan, dan hasil penelitian bersifatdreskriptif analisis, karena ditujukan untuk memberikan data yang seteliti mungkin tentang sifat-sifat hubungan hukum, keadaan atau gejala-gejala tertentu dalam suatu tindakan hukum. Akta jual beli yang dilakukan dengan mengandung sebab yang dilarang Undang-undang (Ongeoorloofde Oorzak) adalah perbuatan yang bertentangan dengan ketentuan yang berlaku, dikarenakan jual beli atas tanah pada dasarnya adalah suatu perbuatan hukum berupa penyerahan hak atas tanah yang bersangkutan untuk selama-lamanya. Pejabat Pembuat Akta Tanahdalam hal ini hanya menjamin kebenaran materiil dan kebenaran formil dalam setiap akta peralihan hak atas tanah dan tidak dapat dipertanggungjawabkan secara hukum terhadap ketidakjujuran klien dalam memberikan informasi;Deed of sale shall be the evidence that is truly has been done the legal act transition of the right of land for permanently, has not been done by breaking the laws (OngeoorloofdeOorzak). The problem of this thesis is how is the legal consequences which is arisen by the deed of sale made by the contains of the causes which is prohibited by the laws (OngeoorloofdeOorzak) on the Supreme Court of Republic of Indonesia Verdict on Number 1369K/PDT/2013, and how is the role and responsibility of Land Deed Registrar with the existence of deed of sale that is made with the contains of the cause that is prohibited by the laws (OngeoorloofdeOorzak). To answer thatproblem, then done the legal research with the normative juridical approach, using secondary data obtained by literature study, and the result of the research tend to analytical prescriptive, because it is intended to provide the data accurately about the nature of legal relationship, circumstances or certain symptoms in a legal act.Deed of sale made by containing the cause of prohibited by the laws(OngeoorloofdeOorzak) is the act that is contrary with the provision in force, because of land sale basically is the legal action which is transfer rights of land for permanently.
