Lelang memiliki fungsi publik dimana pihak yang dinyatakan sebagai pemenang lelang akan memperoleh suatu kepastian hukum dari pejabat lelang dalam kepemilikan objek lelang. Namun dalam praktek dilapangan terdapat permasalahan seperti adanya gugatan terhadap objek lelang, adanya kekeliruan terhadap kantor lelang dalam pelaksanaan lelang dan keabsahan objek lelang itu sendiri. Permasalahannya adalah bagaimana objek lelang tanah HGB di atas HPL, bagaimana perlindungan terhadap pemenang lelang terkait pencabutan ijin pemanfaatan tanah asset pemerintah, dan bagaimana hasil putusan PTUN No.11/G/2009/PTUN.Dps menurut peraturan perundang-undangan yang berlaku. Hasil analisis penulis adalah objek lelang HGB No.80/Desa Kesiman Petilan di atas HPL No.2/Desa Kesiman Petilan tidak mendapat ijin tertulis dari pemegang Hak Pengelolaan untuk menjaminkan HGB kepada pihak ketiga sehingga PPAT sebaiknya menolak pembuatan APHT karena tidak memenuhi data yuridis.Mengenai perlindungan hukum terhadap pemenang lelang karena pencabutan ijin tersebut tidak diikuti permohonan pembatalan Hak Pengelolaan. Maka Hak Pengelolaan masih tetap ada, sehingga pemenang lelang masih dapat menggunakan dan memanfaatkan tanah tersebut sesuai jangka waktu HGB tersebut masih berlaku. Hasil Putusan PTUN No.11/G/2009/PTUN.Dps telah sesuai dengan peraturan perundang-undangan yang berlaku.
