[ABSTRAK Tesis ini membahas tentang unsur-unsur penting yang terdapat dalamExtraordinary Chambers in the Courts of Cambodia (ECCC) dan Special Courtfor Sierra Leone (SCSL) serta tanggung jawab pidana individu yang dapatditerapkan dalam hybrid tribunals. Penelitian ini menggunakan metode deskriptifanalitis. Penulis menganalisa perbandingan antara ECCC dan SCSL sebagaihybrid tribunal dan dari hasil analisa tersebut ditemukan beberapa persamaan danperbedaan dari kedua hybrid tribunal tersebut. Adapun persamaan diantarakeduanya meliputi unsur-unsur yang digunakan dalam peradilan, antara laininstrumen hukum yang digunakan, komposisi hakim, jaksa dan pengacara. Selainitu juga, latar belakang berdirinya kedua hybrid tribunal tersebut memilikikesamaan. Latar belakang tersebut antara lain tidak memadainya sumber daya ditingkat nasional, adanya hambatan dari sistem hukum domestik, tidakmemadainya sistem hukum domestik dan ingin memberikan kontribusi terhadaphak, keadilan dan pengadilan yang efektif. ABSTRACT This thesis discusses the important elements contained in the ExtraordinaryChambers in the Courts of Cambodia (ECCC) and the Special Court for SierraLeone (SCSL) and also the criminal responsibility of individuals that can beapplied in hybrid tribunals. This research uses descriptive analytical method. Theauthor analyzes the comparison between the ECCC and SCSL as a hybrid tribunaland as the results of the analysis, the author found some similarities anddifferences of the two hybrid tribunal. The similarities between the two coveringelements used in court, among other legal instruments are used, the compositionof judges, prosecutors and lawyers. Also, the background of the establishment ofthe two hybrid tribunals have in common.
