Penelitian ini bertujuan untuk mengetahui mengenai pengaturan, kekuatan mengikat pengaturan yang ada dan permasalahan yang terjadi dalam kegiatan usaha ekspor batubara dan produk batubara di Indonesia serta mengetahui permasalahan dari adanya persyaratan rekomendasi ekspor terdaftar batubara. Penelitian ini merupakan penelitian hukum yang bersifat yuridis normatif dengan menggunakan data sekunder, diantaranya peraturan perundangan-undangan, buku, dan wawancara dengan narasumber. Dari hasil penelitian, diperoleh kesimpulan yang menjawab permasalahan, yaitu bahwa pengaturan ekspor batubara dan produk batubara yang ada saat ini memiliki permasalahan, baik ditinjau dari segi teori maupun secara praktis. Selain itu, kedudukan serta kekuatan mengikat Permendag No. 39/M-DAG/PER/7/2014 Jo. NO. 49/M-DAG/PER/8/2014 Jo. Perdirjen Minerba NO. 714.K/30/DJB/2014 masih menjadi pertanyaan. Saat ini masih belum ada Peraturan Menteri Energi dan Sumber Daya Mineral yang dapat mengatur terkendalinya produksi dan ekspor batubara sehingga kegiatan produksi dan ekspor batubara tidak sejalan dengan cetak biru pengelolaan energi nasional. Dalam kaitannya dengan rekomendasi ekspor terdaftar, adanya syarat tersebut hanya dapat menurunkan kegiatan ekspor batubara dan produk batubara dalam kurun waktu tertentu, namun tidak mengurangi permintaan pasar. Padahal, pengendalian ekspor dan produk batubara harus dilaksanakan karena memiliki tujuan jangka panjang untuk menjamin ketahanan energi nasional.
This research aims to determine the regulation, the binding force of the existing regulations and the problems that occur in the business activities of the export of coal and coal products in Indonesia and to find out the impact of the recommendations as a Registered Coal Exporter In Coal Export Activity. This research is a normative legal research by using secondary data, such as regulations, books, and interviews with sources. From the research, it concluded that the regulation regarding the export of coal and coal products that currently applicable today have some problems, both in terms of theory and practical. In addition, the position as well as the binding force of the Regulation Of The Minister Of Trade No. 39/M-DAG/PER/7/2014 Jo. No. 49/ M-DAG/PER/8/2014 Jo. Regulation of the Directorate General of Mineral and Coal No. 714.K/30/DJB / 2014 are still in question. Currently, there is still no regulation in the form of Regulation Of The Minister of Energy and Mineral Resources that can regulate the controlled production and export of coal, so the impact is the coal production and export activities are not in line with the national energy management blueprint. In connection with the recommendation of the registered export, the existence of these requirements can only lower the export of coal and coal products in a certain period of time, but does not reduce the market demand. However, the controlled of the export activity of coal and coal products must be implemented due to its long-term purpose to secure the national energy. |
