Perkembangan teknologi telah memudahkan proses penggandaan dari sebuah karya tulis bahkan mengalihwujudkan kedalam bentuk yang berbeda. Perlindungan atas hak cipta pun harus selaras dengan perkembangan teknologi saat ini untuk memaksimalkan hak ekonomi yang seharusnya diperoleh pencipta mengingat sifat droit de suite yang dimilikinya. Hak ekonomi penulis sebagai pencipta dapat dihasilkan melalui penerbitan; penggandaan; hingga penyewaan ciptaan. Dimungkinkan adanya suatu pemecahan Hak Cipta agar Pencipta mendapatkan keuntungan yang lebih atas karyanya. Penelitian yuridis normatif ini akan menguji apakah pasal 9 Undang- Undang Hak Cipta Nomor 28 Tahun 2014 sudah memenuhi kriteria kelengkapan Hak Ekonomi yang seharusnya didapatkan penulis. Penelitian ini juga menjadikan dua kasus pelanggaran Hak Cipta, yaitu kasus adaptasi Novel relatif tidak terkenal ke sinetron tanpa izin di MNC TV dengan judul berbeda dan pembajakan bit standup comedy yang dialami penulis sekaligus standup comedian Pandji Pragiwaksono, untuk melihat bentuk perlindungan dan metode pengindentifikasian pencurian hak cipta yang tepat sehingga memudahkan pengindentifikasian apakah karyanya dibajak atau tidak. Penelitian ini juga mengkaji sarana upaya hukum yang dapat dilakukan oleh pencipta untuk mendapat perlindungan hukum atas dugaan pembajakan ini, baik preventif ataupun represif, dan menganalisis peran Lembaga Manajemen Kolektif serta model kerjasama yang terbaik antara penulis dengan penerbit atau calon pemegang hak cipta lainnya. The development of technology has facilitated the duplication process of a paper and even changes it into a different media. Protection of copyright must be in tune with the current technological developments to maximize the economic rights that have accrued creators due to the nature of the droit de suite. Economic rights of the author as the creator may be generated through the publishing; duplicating; into leasing creation. It is also possible for a disability of Copyright, which the Creator has the right to breaks down elements of Copyright and gain more profit of his/her work. This normative juridical study will test whether Article 9 of the Copyright Act No. 28 of 2014 has met the standard criteria of Economic Rights which should be obtained by the author. The study also analyze two cases of violation of copyright, namely the case of novel adaptation that relatively unwell known into film without permission on MNC TV with a different title and piracy of standup comedy bit experienced by Pandji Pragiwaksono, to see a proper form of protection and methods of identification on copyright theft, making it easier for authors to conclude whether or not his/her work have been hijacked. This study also examines the means of legal action that can be acted by the creators to get legal protection for alleged piracy, whether preventive or repressive, and analyze the role of Collective Management Institution then give suggestion about the most effective coorporation between author and publishers or other copyright holder candidates. |
