Tesis ini membahas tentang fenomena child abduction yang dewasa ini semakin sering terjadi di Indonesia. Dengan telah ditemuinya kasus-kasus child abduction di Indonesia, keikutsertaan Indonesia dalam Konvensi Hague 1980 perlu dipertimbangkan.Di dalam Konvensi Hague 1980 dibahas mengenai hal-hal antara lain tujuan dari Konvensi, definisi dari pemindahan anak secara tidak sah dan hak pemeliharaan, prosedur pengembalian seorang anak ke negara tempat tinggalnya sehari-hari, alasan-alasan yang menjadi pengecualian untuk pengembalian anak dan lain sebagainya. Dalam tesis ini penulis hanya akan menuliskan mengenai beberapa pasal yang dianggap sebagai inti dari Konvensi seperti yang tersebut di atas, penting untuk diketahui karena mempunyai kaitan erat dengan kasus-kasus yang akan dibahas.Tantangan terbesar Pemerintah Indonesia terkait hal ini adalah keadaan perundang-undangan menyangkut anak dan hukum perkawinan di Indonesia, yang masih kurang sempurna dan masih sangat kurangnya hakim-hakim yang ?ahli? baik dalam kasus-kasus yang berkaitan dengan Hukum Perdata Internasional pada umumnya dan Konvensi Hague 1980 pada khususnya.Hasil penelitian ini menyarankan bahwa Pemerintah Indonesia sebaiknya segera membentuk perangkat yang mendukung berlakunya Konvensi Hague 1980 (antara lain pembentukan Otoritas Pusat, perundang-undangan, pengadilan serta hakim-hakim yang akan ditunjuk dalam mengadili kasus child abduction). This thesis discusses the phenomenon of child abduction that frequently happened nowadays in Indonesia. Based on such a situation, the present author mainly argues that Indonesia should consider its participation to the 1980 Hague Convention on the Civil Aspects of International Child Abduction.Under the 1980 Hague Convention, there are several important provisions provided, including: the objectives of the convention, the definition of the child ?wrongful removal? and custody rights, the procedure of returning the child to the country of habitual residence, and reasons being the exception to the returning the child. However in this thesis, the present author shall focus on some articles that considered as the core provisions of the convention; as they have a strong relation with the cases discussed.On a practical level, this research found that the biggest challenge the Government of Indonesia faced regarding this matter is that the national legislation concerning children and marriage in Indonesia is still less than perfect. Besides, there is also a lack of number of expert judges in both cases relating to Private International Law in general and the 1980 Hague Convention in particular.As a recommendation, this study suggests that the Indonesian Government should immediately promulgate a legal product that supports the application of the 1980 Hague Convention (such as Central Authority, laws, the courts, and the judges who will be appointed to hear the cases of child abduction). |
