ABSTRAK Disertasi ini mengemukakan perihal penyalahgunaan kekuasaan (ekonomi dan politik) oleh korporasi, yang melakukan pelanggaran terhadap hak-hak sosial dan ekonomi masyarakat. Korban tindak pidana yang dilakukan oleh korporasi tersebut antara lain, negara, pemerintah, masyarakat, dan warga negara. Pihak-pihak ini merupakan suatu kelompok korban dari tindak pidana korporasi. Permasalahan yang dihadapi oleh kelompok korban dilatarbelakangi oleh masih kurangnya perlindungan hukum dari pihak pemerintah dalam hal penegakan hukum pada proses peradilan pidana.Adanya perlindungan hukum tidak terlepas pada peranan penegak hukum, yang berfungsi sebagai alat dalam menegakkan hukum untuk mencapai ketertiban dan keadilan pada proses peradilan dan untuk melindungi korban individual maupun kelompok akibat tindak pidana korporasi. Korban tindak pidana korporasi membutuhkan pemulihan kembali bempa kompensasi maupun hukuman kepada pelaku tindak pidana sebagai suatu bentuk pertanggungjawaban dari pelaku yang melakukan tindak pidana.Bentuk atau jenis tanggung jawab pelaku tindak pidana (korporasi) dalam proses peradilan pidana (bqmpa putusan pengadilan), masih berorientasi pada kepentingan atau hak individu dad pelaku tindak pidana. Hal ini menunjukkan bahwa penegakan hukum terhadap tindak pidana korporasi dalam proses peradilan di Indonesia, khususnya pada putusan sidang pengadilan berlandaskan konsep ? asas retributif? yaitu suatu asas yang menitikberatkan kepada kepentingan dan melindungi hak-hak pelaku tindak pidana. Seyogyanya putusan pengadilan dalam menanggulangi masalah tindak pidana korporasi berdasarkan pada konsep ?rasa keadilan masyarakat" yang berasaskan ?keadilan restoratif" tanpa meninggalkan asas ?keadilan retributif? bagi pelaku tindak pidana. Abstract This desertation issues the misuse of power (economicalty and politicalty) by corporation, which violates the social and economic rights of the people. Crime victims caused by those corporation are the state, government, society, and citizens itself. The problem faced by these victims are back grounded by the lack of law protection by the government in law enforcement for judicial crime process.The existence of law protection cannot be separated from the role of law enforcers, functioning as a tool uphold the law to achieve justice in the judicial process and to protect individual and group victims as the result of corporate crime. Corporate crime victims need some medicine for their trauma in the form compensation, and punishment of the party which committed the crime.Forms and types of responsibility of the party which committed the (corporate) crime in the judicial crime process (in the form of court devision) still circles on the interest and individual rights of the party which commited the crime. This shows that the law enforcement againts corporate crimes in the judicial process in indonesia, especially on the court decision, is based on the retributive concept, a concept which concentrates on protecting the best interest and the rights of the party which committed the crime.The court decision in handling a case of corporate crime should be based on the people?s justice concept whith a touch of restorative justice concept without leaving behind the retributive justice concept for the party.
