Skripsi ini membahas tentang pengaruh ketentuan baru yaitu Pedoman Tata Kerja BP Migas No. 40 Tahun 2010 tentang Abandonment and Site Restoration yang dikeluarkan setelah suatu Kontrak Bagi Hasil di tanda tangani dalam hal ini adalah Kontrak Bagi Hasil Blok C. Ketentuan baru ini dikeluarkan oleh badan pelaksana selaku pembuat peraturan dan juga pihak dalam kontrak. Ketentuan tersebut mengatur hal yang baru yaitu mengenai Penempatan Dana ASR dalam rekening bersama di bank dalam bentuk persero. Kontraktor dalam Blok C tidak mematuhi ketentuan tersebut, karena menganggap ketentuan tersebut tidak ada dalam kontrak yang mereka tanda tangani. Penelitian ini menggunakan bentuk penelitian yuridis normatif dengan tipologi deskriptif serta dengan menggunakan metode kualitatif. Hasil penelitian menyarankan bahwa Pedoman Tata Kerja BP Migas No. 40 Tahun 2010 harus tetap berlaku di Kontrak Bagi Hasil Blok C. This thesis discusses the impacts of new regulation, BP Migas Work Procedure Guidelines No. 40/2010 concerning The Abandonment and Site Restoration, which has been issued after Production Sharing Contract of Block C was ratified. This regulation is issued by the implementing agency as a regulator and a party of the pertinent contract. This regulation stipulates a new provision that the contractor shall transfer abandonment and the site restoration fund to an escrow account in government bank. The Contractors in Block C do not comply with the regulation, because they consider that such regulation is not postulated in The Production Sharing Contract of Blok C. This study uses normative juridical approach with a descriptive typology and a qualitative method. The result thereof is to suggest that BP Migas Work Procedures Guidelines No.40/2010 shall be applied to The Production Sharing Contract of Block C. |
