Skripsi ini membahas mengenai bagaimana harta bersama diatur baik dalam Undang-Undang Nomor 1 Tahun 1974 maupun Kompilasi Hukum Islam. Menurut Pasal 97 Kompilasi Hukum Islam, pembagian harta bersama ditentukan setengah bagian untuk masing-masing suami istri, namun dalam Putusan Pengadilan Agama Bengkalis No. 0282/Pdt.G/2015/PA. Bkls, hakim memutuskan bagian harta bersama yang berbeda dari apa yang ditentukan dalam Kompilasi Hukum Islam, yaitu 1/3 bagian untuk istri dan 2/3 bagian untuk suami. Berdasarkan hal tersebut, Peneliti mengajukan pokok permasalahan, yaitu: 1. Bagaimanakah Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam mengatur mengenai harta bersama dan pembagiannya dalam hal terjadi perceraian?; 2. Apakah pertimbangan hukum hakim dalam Putusan Pengadilan Agama Bengkalis Nomor 0282/Pdt.G/2015/PA. Bkls sudah tepat berdasarkan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam? Bentuk penelitian ini bersifat yuridis normatif dengan tipe penelitian deskriptif analitis.Pada akhirnya, Peneliti memperoleh kesimpulan bahwa Undang-Undang Nomor 1 Tahun 1974 menyerahkan pengaturan mengenai pembagian harta bersama kepada hukumnya masing-masing, sedangkan Kompilasi Hukum Islam mengatur masing-masing suami istri mendapatkan setengah bagian dari harta bersama. Peneliti juga memperoleh kesimpulan bahwa pertimbangan hukum hakim dalam putusan yang dibahas dalam penelitian ini adalah kurang tepat karena istri juga telah berkontribusi dengan baik dalam usaha mendapatkan harta bersama sehingga berhak untuk mendapat bagian harta bersama yang sama dengan suami. This thesis focuses on how joint assets are regulated, both in Law No. 1 of 1974 and Compilation of Islamic Law. According to the Article 97 of Compilation of Islamic Law, the division of joint assets are determined half portions for each husband and wife, but the Bengkalis Religious Court Judgment No. 0282/Pdt.G/2015/PA.Bkls gave a different portion from what has been determined in Compilation of Islamic Law, 1/3 for the wife and 2/3 for the husband. Based on the preceding, the Writer formulated and discussed the following problems: 1. How Law No. 1 of 1974 on Marriage and the Compilation of Islamic Law regulates the joint asset and its distribution as a result of divorce?; 2. Is the judge in the Bengkalis Religious Court Judgment No. 0282/Pdt.G/2015/PA.Bkls had a proper legal considerations based on Law No. 1 of 1974 on Marriage and the Compilation of Islamic Law? This research is in the form of a normative juridical with the type of descriptive analytical research.At the end, the Writer arrived at the conclusion that Law No. 1 of 1974 handed regulations regarding the joint assets division to the respective laws, while the Compilation of Islamic Law regulates that each husband and wife get half of the joint assets. The Writer also came to the conclusion that the judge?s legal considerations in the judgment discussed in this research are less proper because the wife has contributed well in the attempt to gain the joint assets so she is entitled to get a same portion of the joint assets with her husband. |
