 Abstract
ABSTRAK
Skripsi ini membahas mengenai kedudukan Berita Acara Pemeriksaan (BAP) Penyidikan di persidangan dan kedudukan saksi verbalisan sebagai pengganti Berita Acara Pemeriksaan (BAP) Penyidik yang dicabut dalam persidangan. Sistem Peradilan Pidana Indonesia menganut asas inkuisitorial modern yang memfokuskan pemeriksaan pada tahap penyidikan, namun tetap harus mengingat prinsip nonself incrimination dan hak-hak Terdakwa. Berita Acara Pemeriksaan (BAP) Penyidik dapat dinilai sebagai alat bukti yang sah, jika dilakukan secara sah, namun pembuktian sah belum diatur secara rinci oleh KUHAP. Berita Acara Pemeriksaan (BAP) Penyidik di Belanda disamakan dengan Alat Bukti karena adanya Examinateur Magistrate atau Rechter Commisariss yang bersifat objektif atau netral dan adanya bukti rekaman yang menyatakan proses pemeriksaan dilakukan secara sah.
ABSTRACT
Minutes of Investigation in the trial and position of investigator?s testimony as a substitute when investigator?s dossier is revoked in the trial. The Criminal Justice System in Indonesia adheres to the principle of the modern inquisitor that not only focuses at the investigation phase, but also focuses at principles of nonself incrimination and the rights of the accused or defendand. Dossier can be considered as valid evidence if it is done due of process. But the procedure has not set in detail by the Code of Criminal Procedure in Indonesia. Dossier in Netherlands equal with evidence for their Rechter Commissaris whose objective and neutral, besides that there are record evidence as a prove to due of process.
