Abstrak

ABSTRAK

Seni Tato Mentawai merupakan bagian dari warisan budaya tertua di Indonesia

yang berlu dilindungi Hak Kekayaan Intelektualnya. Tato Mentawai cukup unik

walaupun tatonya memiliki motif yang cukup sederhana, namun dibalik setiap

motif itu memiliki pengertian tersendiri. Oleh karena itu permasalahan yang

dibahas adalah bagaimana perlindungan seni tato tradisional ditinjau dari UU Hak

Cipta No. 28 Tahun 2014, apakah perlindungan warisan budaya sudah memadai

dan efektif dan upaya-upaya apa yang dapat ditempuh Pemerintah Daerah

Provinsi Sumatera Barat beserta Pemerintah Indonesia untuk melindungi seni tato

tradisional Mentawai. Penelitian menggunakan metode normative yuridis dengan

pendekatan kualitatif. Dari hasil penelitian diketahui bahwa pengaturan mengenai

Hak Cipta seni tato dalam hal ini dapat dikategorikan dalam seni motif sudah ada

sejak UU Hak CIpta Tahun 1987 sampai dengan saat ini dengan UU Hak Cipta

No. 28 Tahun 2014. Saat ini perlindungan seni motif diatur pada Pasal 40 ayat (1)

huruf f UU Hak Cipta No. 28 Tahun 2014. Pada pasal tersebut yang dilindungi

adalah karya seni rupa dalam segala bentuk seperti lukisan, gambar, ukiran,

kaligrafi, seni pahat, patung, atau kolase yang menunjukkan keasliannya dan

dibuat secara konvensional. Sedangkan untuk seni motif yang merupakan warisan

budaya yang diwariskan dari generasi ke generasi diatur pada Pasal 38 ayat (1)

UU Hak Cipta No. 28 Tahun 2014 dan Hak Ciptanya dipegang oleh Negara.

Pengaturan mengenai perlindungan hak cipta ekspresi budaya belum memadai dan

efektif karena belum ada kejelasan dalam penerapan Pasal 38 ayat (1). Peraturan

pelaksanaannya yang berupa Peraturan Pemerintah sampai saat ini belum terbit.

Upaya Pemerintah Daerah Provinsi Sumatera Barat untuk melindungi seni tato

tradisional Mentawai adalah dengan meningkatkan kegiatan pariwisata. Namun

kesadaran untuk melindungi hak cipta seni tato tradisional masih kurang.

ABSTRACT

Tattoo art is part of the Mentawai of Indonesia's oldest cultural heritage needs to

be protected Intellectual Property Rights. Tattoos Mentawai tattoo is quite unique

though motives are quite simple, but behind every motive that has its own

understanding. Therefore, the issues discussed was how the protection of

traditional tattoo art in terms of the Copyright Act No. 28, 2014, whether the

cultural heritage protection is adequate and effective and what measures can be

taken by the Government of West Sumatra Provincial Government together with

Indonesia to protect traditional Mentawai tattoo art. Using normative juridical

research with qualitative approach. The survey results revealed that the

arrangements regarding the Copyright art of tattooing in this case can be

categorized in art motif has existed since the Copyright Act 1987 up to now by the

Copyright Act No. 28 Year 2014. The motif art protection provided by Article 40

paragraph (1) f of the Copyright Act No. 28, 2014. In the article is protected are

works of art in all forms such as paintings, drawings, engravings, calligraphy,

sculpture, sculpture or collage that shows originality and prepared conventionally.

As for the art motif which is a cultural heritage passed down from generation to

generation provided by Article 38 paragraph (1) of the Copyright Act No. 28

Copyrighted 2014 and held by the State. Arrangements regarding the copyright

protection of cultural expressions has not been adequate and effective because

there is no clarity in the application of Article 38 paragraph (1). Its implementing

regulations in the form of government regulation has not been published until

now. Efforts of Local Government of West Sumatra Province to protect the

traditional Mentawai tattoo art is to increase tourism activities. But awareness of

copyright to protect their traditional tattoo art less.
