ABSTRACT Dalam perlindungan terhadap tenaga kerja di Indonesia perusahaan diwajibkanoleh undang-undang untuk memberikan proteksi terhadap para pekerja, Parapekerja dalam melaksanakan kewajiban nya dapat mengalami berbagai macamresiko terutama resiko kesehatan oleh karena itu dibutuhkan instrument penjaminuntuk memenuhi kesehatan para pekerja tersebut. Dalam hal ini ada dua bentukinstrumen penjamin pemenuhan jaminan kesehatan para pekerja tersebut yakniAsuransi Kesehatan BPJS yang diwajibkan oleh undang-undang dan AsuransiKesehatan Komersial terhadap perusahaan yang berdasarkan kemampuanyamenggunakan jaminan terhadap para pekerja tersebut. Sebuah kondisi timbuldimana dalam praktiknya masih banyak perusahaan yang menyediakan dua buahinstruments tersebut di dalam perusahaan mereka. Pokok permasalah dalamskripsi ini adalah bagaimana penerapan kedua instrument tersebut dalamperusahaan di Indonesia, dimana BPJS bersifat wajib namun perusahaan tetapmenggunakan Asuransi Kesehatan Komersial untuk menjamin kesehatan parapekerja nya dan bagaimana perbandingan jaminan yang ditanggung oleh keduabuah jaminan tersebut. Metode Penelitian yang digunakan adalah metodepenelitian yuridis normatif, yaitu penelitian yang dilakukan terhadap hukumpositif tertulis maupun tidak tertulis. Penelitian ini menyimpulkan bahwa undangundangno 24 tahun 2011 Mengenai Badan Penyelenggara Jaminan Sosial hanyamewajibkan penerapan BPJS walaupun pada kenyataan perusahaan lebihcenderung memakai asuransi komersial karena dirasa lebih menguntungkan Untukmenyiasati hal ini BPJS menerapkan cob agar penerapan undang-undang efektifdan menguntungkan kedua belah pihak. ABSTRACT In the protection of labor in Indonesia Companies are required by law to provide protection to workers, workers in carrying out its obligations can experience a wide variety of health risks, especially health risk therefore required guarantor instrument to meet the health of these workers. In this case there are two forms of guarantor instruments fulfilling the health insurance of these workers the Health Insurance BPJS required by law and the Commercial Health Insurance by the company by its ability to take out insurance against these workers. A condition which arises in practice there are many companies that provide these two instruments within their company. The principal problems in this thesis is how the application of the two instruments in Indonesia company, where BPJS be compulsory but the company still uses a commercial health insurance to ensure the health of its workers and how it compares to guarantee by the two instruments by these warranties. Methods used are normative juridical research method, the research done on the positive law written and unwritten. This study concluded that the law No. 24 of 2011 Concerning Social Security Agency. only requires the application of BPJS despite the fact the company is more tend to use commercial insurance because it is considered more profitable. To get around this, BPJS apply the cob for the application of the laws effective and beneficial for both parties. |
