Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik yang sebagaimana dimaksud dalam Undang-Undang Jabatan Notaris. Sebagai suatu jabatan mempunyai arti bahwa terdapat batas waktu sehingga terdapat saat dimana Notaris tersebut tidak lagi menjabat sebagai notaris. Dalam UUJN Notaris dituntut untuk dapat bertanggung jawab terhadap akta yang dibuatnya meskipun protokol notaris tersebut telah diserahkan kepada notaris lain sebagai notaris penyimpan protokol notaris. Perlindungan hukum terhadap Notaris telah dimuat dalam UUJN pasal 66 namun perlindungan hukum yang dimaksud tidak berlaku bagi notaris yang tidak lagi menjabat sebagai notaris, sehingga dalam hal ini masih terdapat kekosongan hukum yang kita lihat bahwa dalam pasal 65 UUJN menyatakan bahwa notaris masih bertanggung jawab atas akta yang dibuatnya tersebut, disini juga terdapat kekosongan hukum yang mana batas waktu sampai kapan notaris itu bertanggung jawab. Dan mengkaji mengenai fungsi Ikatan Notaris Indonesia yang menjadi satu-satunya organisasi Notaris dalam memberikan perlindungan hukum kepada Notaris yang purna bakti tersebut. Maka dari itu penulis membuat penulisan terkait dengan permasalahan tersebut, dengan melakukan penelitian yuridis normatif untuk menjawab permasalahan mengenai mengapa notaris yang purna bakti masih tetap harus bertanggung jawab dan batas pertanggung jawabannya sampai dengan perlindungan hukum terhadap notaris purna bakti tersebut. Dengan itu penulis juga menambahkan tidak hanya dari sisi UUJN tetapi penulis juga mengkaji penelitian ini dengan teori tanggung jawab dan teori perlindungan hukum. Dalam penelitian ini memperlihatkan bahwa tanggung jawab Notaris berhubungan dengan teori tanggung jawab jabatan dan Notaris yang telah purna bakti masih mendapat perlindungan yang sesuai dengan pasal 65 dan pasal 66 UUJN dan juga dari organisasi yang Notaris itu sendiri Notary is a public official who is authorized to make authentic deed that referred to Law of Notary. As an office (position) means that there is a time limit, there are times when the Notary no longer served as a notary. In Notary act, Notaries are required to be responsible for the deed that he made even though the notary protocol has been submitted to another notary as a public notary that keep the protocol. Legal protection of the Notary has been published in Notary Act Article 66, but the protection of the law that referred to does not apply to notaries who are no longer served as a notary, so that in this case there is still a legal blankness that we see that in the article 65 of Notary Act stated that the notary is responsible for the deed he made it, here too there is a legal blankness in which until when the notary was responsible. And assess the function of the Indonesian Notary Association is the sole organization Notary in providing legal protection to the Notary the full devotion. Thus the authors make the writing related to the problem, by conducting a normative juridical research to address issues about why the notary after-service still have to be responsible and accountable to the limit of legal protection against the notary full devotion. By the author also adds not only from the Notary Act but the authors in this study also examines the theory of liability and legal protection theory. In this research show that retired notary responsibility relates to the liability theory and notaries who have retired still receive protection in accordance with article 65 and article 66 UUJN and also from the Notary organization itself. |
