ABSTRAK Sertipikat tanah yang diterbitkan berlaku sebagai alat pembuktian yang kuat, namunapabila seseorang dapat membuktikan bahwa tanah tersebut sebagai miliknya maka iadapat mengajukan keberatan ke pengadilan, pada putusan Putusan Pengadilan NegeriDenpasar Nomor 116/Pdt.Plw/1996/PN.DPS terdapat tumpang tindih antara satubidang tanah dengan yang lainnya di Desa Pemecutan kota Denpasar provinsi Bali,permasalahan pada penelitian ini yaitu apakah yang menyebabkan terjadinya kesalahanproses pengukuran dalam penerbitan sertipikat hak milik nomor 3038/Desa Pemecutanserta apakah pertimbangan Kepala Kantor Pertanahan kota Denpasar untukmembatalkan sertipikat yang sedang bersengketa sesuai dengan ketentuan yang berlaku.Penelitian ini menggunakan metode penelitian kepustakaan yang bersifat yuridisnormatif, kesimpulan dari penelitian ini yaitu penyebab terjadinya kesalahanpengukuran dalam penerbitan sertipikat pada kasus tersebut karena kesalahan prosedurpada saat pembuatan surat ukur, serta ketidaktelitian pejabat kantor pertanahan kotaDenpasar, pertimbangan Kepala Kantor Pertanahan kota Denpasar untuk membatalkankedua sertipikat yang sedang bersengketa telah sesuai dengan ketentuan yang berlaku,sebagaimana diatur dalam pasal 103 PMNA/KBPN 9/1999, maka tanpa adapermohonan pembatalan, Kepala Badan Pertanahan Nasional dapat mengeluarkankeputusan pembatalan hak tersebut ABSTRACT Land certificate which issued served as strong evidence of ownership, but if someonecan prove that the land as his own then he may appeal to court, in denpasar districtcourt verdict number 116/PDT.PLW/1996/PN.DPS there is overlap between the plotwith the others in the village of Pemecutan City of Denpasar at Bali province, Theproblem in this research is what causes an error in the measurement process of issuanceof certificates of property rights number 3038 /Desa Pemecutan and whether theconsideration of the Head Office of Denpasar city to cancel certificates dispute inaccordance with applicable regulations, This literature research used juridicalnormative research, The conclusion of this study is the cause of measurement error inthe issuance of the certificate in the case because of procedural errors during certificatemeasurement, as well as the inaccuracy of Denpasar city land office officials.Consideration of the Head Office of Denpasar city to cancel the certificate the disputein accordance with the applicable provisions, as stipulated in article 103 PMNA /KBPN 9/1999, then without any request for cancellation, the National Land Agencyhave the right to issue certificate cancelation proposal |
