Abstract
Tesis ini membahas permasalahan penetapan nilai ganti kerugian pengadaan tanah dalam kasus pembangunan Tol Trans Jawa di Kabupaten Jombang, Kabupaten Mojokerto, dan Kota Malang. Pihak yang berhak tidak sepakat dengan nilai ganti kerugian yang ditawarkan oleh Panitia Pengadaan Tanah karena merasa nilai tersebut tidak layak dan adil. Penelitian ini adalah penelitian kualitatif dengan desain evaluatif.
Hasil penelitian menyarankan bahwa penetapan nilai ganti kerugian oleh Penilai dilakukan secara transparan dan seharusnya pihak yang berhak yang berkeberatan mengajukan gugatan ke Pengadilan Negeri atau Panitia Pengadaan Tanah menempuh cara konsinyasi sesuai jangka waktu yang ditentukan oleh peraturan perundang-undangan agar pengadaan tanah tidak terhambat.
This thesis discusses the problem of determination of the value of compensation for land acquisition in the case of the construction of the Trans Java toll in Jombang Regency, Mojokerto Regency and Malang City. The parties that has the right disagrees with the value of of compensation offered by Land Acquisition Committee because they feel the value is not well worth and fair. This study is a qualitative research design evaluative. Results of the study suggest that the determination of the value of compensation by the Valuer must be transparent and should the party entitled to file a lawsuit objecting to the District Court or the Land Acquisition Committee to take on consignment in accordance period of time determined by the legislation so that the land acquisition is not obstructed.
