Abstract
Tesis ini membahas tentang tinjauan hukum terhadap liberalisasi perdagangan jasa bidang perasuransian berdasarkan komitmen Indonesia dalam ASEAN Framework Agreement on Services (AFAS). Dalam menganalisa model penmasokan jasa asuransi, Penulis mencoba melakukan tinjauan hukum secara terbatas pada produk hukum tingkat Undang-Undang untuk sektor perasuransian yaitu Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian. Mengingat Indonesia telah membuka akses pasar sektor perasuransian bagi pemasok jasa asing, maka analisis hukum atas peraturan perasuransian dikaitkan pula dengan komitmen Indonesia sebagaimana tercantum dalam Schedule of Specific Commitment Indonesia dalam AFAS.
This thesis discusses about the legal review of the liberalization trade in insurance services based on the commitment of Indonesia in the ASEAN Framework Agreement on Services (AFAS). author tried analyzing the supply of insurance services, limited to the level of legal products Act for the insurance sector, specifically Law of the Republic of Indonesia Number 40 2014 about Insurance. Given that Indonesia has opened the insurance sector market access for foreign service suppliers, the legal analysis of the insurance regulation is associated also with the commitment of Indonesia in the Schedule of Specific Commitment Indonesia in AFAS.
