ABSTRAK Kredit bagi bank merupakan salah satu hal yang utama, karena salah satupendapatan terbesar dari bank berasal dari pemberian kredit. Dalam praktek sering ditemukan permasalahan dalam pembayaran kredit oleh debitur sehingga bank harus melakukan alternatif penyelesaian permasalahan, salah satunya adalah dengan pengalihan piutang atas nama (cessie). Permasalahan dalam tesis ini adalah mengapa terjadi pengalihan piutang (cessie) atas perjanjian kredit pada bank dan bagaimana tindakan wanprestasi yang dilakukan oleh debitur kepada penerima pengalihan piutang (cessionaris) dalam Putusan Pengadilan Negeri Bogor Nomor 90/Pdt.G/2014/PN.Bgr. Untuk menjawab permasalahan dalam tesis ini menggunakkan penelitian hukum normative dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Untuk pengumpulan data dilakukan dengan penelitian kepustakan. Salah satu alasan Bank untuk mengalihkan piutang yang dimilikinya adalah karena bank harus menjaga status keuangan yang dimilikinya. Hal itu dikarenakan bank merupakan lembaga keuangan yang mendukung perekonomian suatu negara. Tindakan wanprestasi yang dilakukan oleh debitur kepada cessionaris dalam putusan Pengadilan Negeri Bogor Nomor 90/Pdt.G/2014/PN.Bogor adalah terkait dengan tindakan debitur tidak memenuhi kewajiban pembayaran sebagaimana tertuang dalam perjanjian kredit juncto akta pengalihan piutang kepada cessionaris. Selain itu debitur mengingkari keabsahan pengalihan piutang tersebut, walaupun jika melalui bukti-bukti yang diberikan oleh bank, proses pengalihan piutang tersebuttelah sesuai dengan kaidah hukum yang berlaku. ABSTRACT Credit for bank is one of its main activity, because one the biggest revenue forbank came from credit. In practice, there are often found non performingpayments of credit made by the debtor, therefore the bank conducts settlement solutions to these problems, one of them is assigning the credit (cessie). Problems found on this thesis are why there is an assignment of credit (cessie) of the bank credit agreement and how the breach of contract made by the debtor to the assignee of the credit in Bogor District Court's Decision No. 90/Pdt.G/2014/PN.Bgr. To solve the problems on this thesis then the normative legal research is used and using secondary data consist primary, secondary and tertier legal materials, for data funding the library research is done. One of the reason the bank have to assign the credit owned by them that the bank has to secure its financial status. It is because the bank is the financial institution which supports the economy of a country. The breach of contract which is made by the debtor to the cessionaris which was found in Bogor District Court's Decision No. 90/Pdt.G/2014/ PN.Bgr was related to the act of the debtor which he did not fulfill his payment obligation as stated in the credit agreement juncto the assignment of credit act. As an addition, the debtor also denny the validity of the assignment of credit, although if by the evidences given by the bank, the assignment process is in accordance with the valid rule of law. |
