ABSTRAK Dalam praktek hukum sehari-hari terdapat satu jenis surat kuasa dengan memakai klausul tidak dapat dicabut kembali? atau lebih dikenal dengan surat kuasa mutlak. Surat kuasa bentuk ini merupakan penyimpangan dari pasal 1813 Kitab Undang-undang Hukum Perdata (KUHPer). Dalam pasal ini diatur tentang cara pengakhiran pemberian kuasa. Tesis ini membahas kasus antara pemilik hak atas tanah dan atau/bangunan sebagai pemberi kuasa dengan Notaris sebagai pejabat yang membuat akta perjanjian pengikatan jual beli (PPJB), dan pembeli. Dalam PPJB tersebut tercantum klausul tidak dapat dicabut kembali? yang ternyata merugikan pihak pemilik hak atas tanah dan/atau bangunan tersebut sebagai pemberi kuasa. Dalam pembuatan akta PPJB tersebut, parapihak sepakat menitipkan sertipikat hak milik atas tanah kepada Notaris sampai harganya telah lunas dibayar oleh Pembeli selaku penerima kuasa. Namun ternyata Notaris menyerahkan sertipikat tersebut kepada penerima kuasa padahal harganya belum lunas. Penyerahan sertipikat tersebut diserahkan atas dasar surat kuasa mutlak yang telah dicantumkan dalam PPJB tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan tipe penelitian deskriptif dengan data sekunder yang bersumber dari kepustakaan. Dari hasil pembahasan bahwa dalam Instruksi Menteri Dalam Negeri Nomor 14 Tahun 1982, dengan tegas melarang penggunaan kuasa mutlak atas pemindahan/pengalihan hak atas tanah ABSTRACT In the daily practice of laws, irrevocable power of attorney or better known as the absolute power of attorney is found. This type of power of attorney is used to waive article 1813 of the Civil Code Act which governs the aspects to terminate the power of attorney. This thesis discusses cases between owners rights to land and / or building as beneficiary, Notary as a public officers who make agreement of sale and purchase binding and the buyer. In that agreement contained the clause " irrevocable which turned out to be detrimental to the owner of rights to land and / or building as a principal. Inmaking the deed of that PPJB, the parties agreed to entrust the certificate of title for the land to the Notary until the price has been paid by the buyer as attoney. But apparently Notary hand over the certificates to the attoney even though the price has not been paid. That handover certificate was submitted on the basis of the absolute power of attorney which has been included in that deed. The research method used normative with descriptive type with secondary data obtained from the literature.
