Skripsi ini membahas mengenai permasalahan yang terdapat pada sektor telekomunikasi khususnya pada hal penetapan tarif interkoneksi pada telepon seluler. Hal ini sedang marak menjadi perdebatan pada beberapa waktu terakhir. Pemerintah telah mengatur mengenai penetapan tarif interkoneksi di dalam Peraturan Menteri No. 8/Per/M.KOMINFO/02/2006 tentang Interkoneksi. Untuk itu perlu dilihat apakah bentuk penetapan tarif interkoneksi yang berlaku di Indonesia sudah sesuai dengan pengaturan tersebut sehingga tidak ada pihak-pihak yang dirugikan dalam penyelenggaraan penetapan tarif interkoneksi. Terdapat 2 bentuk pengaturan penetapan tarif interkoneksi yang di terapkan di dunia yaitu sistem simetris dan sistem asimetris yang mana pengaturannya diatur berbeda di tiap-tiap negara. Penelitian yang digunakan dalam penulisan skripsi ini adalah metode yuridis normatif yang mana menggunakan peraturan-peraturan terkait dengan topik pembahasan. Dari penelitian yang dilakukan terhadap topik yang diangkat dapat disimpulkan bahwa metode penghitungan tarif interkoneksi yang tepat bagi Indonesia adalah metode penghitungan asimetris dikarenakan apabila menggunakan metode penetapan tarif secara simetris maka akan terdapat operator seluler yang dirugikan dan operator seluler yang diuntungkan dari metode tersebut sehingga memunculkan adanya unfair treatment. Terhadap hal tersebut maka penulis menyarankan bahwa metode penetapan tarif interkoneksi yang lebih tepat untuk dikembangkan saat ini adalah metode asimetris mengingat pentingnya semangat persaingan usaha yang tertuang dalam Undang-Undang Persaingan Usaha. This thesis is about to explain the problem that occurs in telecomunication sector, especially in the determination of interconnection fare in cellular phone. For the last couple of years, there are many discussions about this problem, that make this problem even more happening. The goverment already set this interconnection fare in the Peraturan Menteri No. 8 Per M.KOMINFO 02 2006 about interconnection. Therefore, the goverment should review again, that this determination of interconnections fare that exist in Indonesia is already suitable with the ministrial regulation, so that there is not any loss party in the determination of interconnections fare. There are two forms of determination of interconnections fare, which is symmetrical system and asymmetrical system, which has the difference regulation in each country. The research that is been used in this thesis, is using the methods of juridical normative, which use the regulations that connected with the main topic. From the research that done on each topic, there is some conclussion, that the count interconnection fare, that considered appropiate for Indonesia is the asymmetric count. The use of asymmentric count, is because if Indonesia use the symmetrical count, there will be cellular operator, that get benefit from those method, so that will be an unfair treatment. In consequence to this problem, the writer come to some suggestion, that the most appropiate method for determination interconnection fare is the asymmetry method, due to the business competition that written on Constitution of Business Competition. |
