ABSTRAK<>br> Dalam rangka peningkatan peredaran kosmetik lokal maupun impor di Indonesia, pemerintah telah membuat ketentuan mengenai notifikasi kosmetik untuk melindungi masyarakat dari kosmetik yang membahayakan kesehatan. Namun pada kenyataannya, tingkat peredaran kosmetik tanpa notifikasi masih cukup tinggi. Salah satu nya pada sarana salon kecantikan. Sebagai pelaku usaha, salon kecantikan dianggap mengabaikan hak-hak konsumen sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Terkait dengan pelindungan konsumen atas kosmetik dan penggunaan kosmetik tanpa notifikasi, skripsi ini akan membahas mengenai pengaturan notifikasi kosmetik, pelanggaran hukum yang dilakukan oleh salon kecantikan, dan tanggung jawab salon kecantikan terhadap kerugian konsumen. Dari hasil penelitian ini, dapat disimpulkan bahwa setiap kosmetik yang diedarkan harus memiliki izin edar berupa notifikasi; terkait penggunaan kosmetik impor tanpa notifikasi, salon kecantikan telah melanggar beberapa ketentuan dalam Undang-Undang Perlindungan Konsumen, Undang-Undang Kesehatan, Peraturan Pemerintah No. 72 Tahun 1998 tentang Pengamanan Sediaan Farmasi dan Alat Kesehatan, Peraturan Menteri Kesehatan Republik Indonesia Nomor 1176/MENKES/PER/VIII/2010 tentang Notifikasi Kosmetika, dan beberapa peraturan BPOM RI; dan salon kecantikan dapat diminta pertanggungjawaban perdata maupun pidana atas kerugian konsumen akibat penggunaan kosmetik tanpa notifikasi. Dalam penelitian ini, digunakan metode penelitian normatif, yaitu penelitian terhadap aturan-aturan hukum dengan menggunakan studi kepustakaan dan wawancara.
ABSTRACT
By the massive flow of local and imported cosmetics in Indonesia, the government has issued strict regulation regarding cosmetics notification to protect its citizen from the dangerous risks of cosmetics. But in fact, the circulation of cosmetics without the notification is still high. One of the cases occured in beauty salon. As a businessman, beauty salon has disregard the consumer rights as mentioned in the Act No. 8 of 1999 on Consumer Protection. Related to consumer protection on cosmetics and the usage of cosmetics without the notification, this thesis will discuss regarding cosmetics notification regulations, violation by the beauty salon, and beauty salon responsibility to the consumer who suffered losses. From this research, it can be concluded that every cosmetics that will be circulated must have a marketing authorization in the form of notification related to the usage of imported cosmetics without the notification, beauty salon has disregard several provisions of the Consumer Protection Act, Health Act, Government Regulation No. 72 of 1998 on the Safeguarding of Pharmaceutical Preparation and Medical Devices, Regulation of the Minister of Health No. 1176 MENKES PER VIII 2010 of Cosmetics Notification, and some rules of BPOM RI also, beauty salon can be held accountable of private and civil liability due to consumers losses. This research is used with the normative method of written law, which based on literature and interview. |
