ABSTRAK ABSTARKPembahasan dalam skripsi ini adalah pelaksanaan hak-hak kreditor separatis dan pekerja/buruh sebagai kreditor preferen dalam pemberesan harta pailit dengan studi kasus kepailitan PT Jaba Garmindo. Setelah debitor dinyatakan pailit, maka debitor tidak lagi berwenang mengurus harta pailit melainkan sudah menjadi wewenang curator untuk membereskan harta pailit. Dengan adanya harta pailit tersebut, terdapat kreditor-kreditor yang memiliki hak untuk diberikan pembayaran atas piutang-piutangnya. Sebagai perusahaan, pekerja/buruh akan ditarik menjadi kreditor karena dengan adanya Pemutusan Hubungan Kerja PHK , maka mereka berhak untuk mendapatkan pembayaran-pembayaran sesuai dengan ketentuan Undang-Undang Nomor 23 tahun 2003 tentang Ketenagakerjaan UU Ketenagakerjaan . Namun disisi lain, kreditor separatis juga memiliki hak untuk diberikan pembayaran atas piutang-piutangnya yang ketentuannya diatur dalam Undang-Undang Nomor 37 tahun 2004 UUK-PKPU tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Penelitian ini adalah penelitian yuridis normatif dengan tipologi penelitian deskriptif. Dalam penelitian ini yang menjadi pokok permasalahan adalah keberlakuan pasal 95 ayat 4 UU Ketenagakerjaan berdasarkan UUK-PKPU dan peraturan-peraturan lain, termasuk Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013. Peneliti memperoleh kesimpulan bahwa pemberesan harta pailit PT Jaba Garmindo telah tidak sesuai dengan ketentuan yang terdapat dalam peraturan perundang-undangan yang terkait dengan kepailitan karena bertentangan dengan ketentuan yang diatur dalam Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013. ABSTRACT TThe discussion in this thesis is the implementation of the secure creditor rights and workers laborers as a preferred creditor in the bankruptcy estate settlement with the case studies of PT Jaba Garmindo bankruptcy. After debtor is declared bankrupt, the debtor is no longer authorized to take care of the bankruptcy asset but it has become a curator authority to settle the bankruptcy asset. Given the bankruptcy asset, there are creditors who have the right to be given a payment on debtor rsquo s debts. As a company, workers laborers will become a creditor because of the presence of Termination PHK , then they are entitled to receive payments in accordance with the provisions of Law No. 23 of 2003 on Manpower Act. On the other hand, the secured creditor also has the right to be given payment for debtor rsquo s debts on the provisions stipulated in Law No. 37 of 2004 on Bankruptcy and Suspension of Payment Act UUK PKPU . This research is a descriptive study with normative juridical typology. In this study, the issue of concern is the applicability of Article 95 paragraph 4 of Manpower Act based on UUK PKPU other regulations that have connection with bankruptcy, including the Constitutional Court Decision No. 67 PUU XI 2013. Researchers came to the conclusion that the settlement of PT Jaba Garmindo rsquo s bankruptcy asset was not in accordance with the provisions contained in the legislation relating to bankruptcy because it contradicts the provisions that stipulated in the Constitutional Court Decision No. 67 PUU XI 2013 |
