ABSTRAK Skripsi ini membahas mengenai tanggung jawab sekolah dan guru terhadap suatu kerugian murid dalam hal terjadi perbuatan melawan hukum, dengan bentuk penelitian yuridis normatif, metode penelitian studi kepustakaan, dan menggunakan data sekunder. Pada dasarnya, pengaturan mengenai perbuatan melawan hukum yang termuat dalam KUHPerdata mengatur bahwa setiap orang yang karena kesalahannya menerbitkan kerugian, wajib untuk mengganti kerugian tersebut, tetapi orang yang tidak menerbitkan kerugian tersebut menurut KUHPerdata juga bisa dimintakan pertanggungjawaban. Di Indonesia sendiri belum terdapat aturan yang jelas mengatur mengenai tanggung jawab sekolah dan guru terhadap muridnya. Sejauh mana sekolah dan guru yang memiliki kewajiban terhadap murid tersebut dapat dimintakan pertanggungjawaban terhadap suatu kerugian yang dialami murid akan dibahas dalam skripsi ini. ABSTRACT This thesis discusses the school and teacher liability for the loss which student underneath their obligation has suffered, with the shape of the normative juridical research, literature study method, and using secondary data. Basically the unlawful act regulations contained in the Civil Code stipulates that every unlawful act that causes damage onto another person, obliges the wrongdoer to compensate such damage, as well as for that which caused by the acts of individuals for whom he she is responsible are also liable to compensate. In Indonesia, there hasn rsquo t had a certain and clear regulations towards the school and teacher liability due to student rsquo s loss. In what conditions or circumstances the school and teacher are liable for its student rsquo s injury will be discussed in this thesis. |
