ABSTRAK Nama : Dwi Hastuti AyuningtyasNPM : 1406511124Program Studi : Magister KenotariatanJudul : Penerapan Asas Kepastian Hukum Dalam Penerbitan Sertipikat Hak Guna Bangunan Oleh Badan Pertanahan Nasional Analisis Putusan Kasus Nomor 3091 K/PDT/2011 Dalam kasus nomor 3091 K/Pdt/2011 telah terjadi sengketa antara Ramon Widjaja dengan pihak-pihak yang dianggap telah menguasai dan memanfaatkan lahan miliknya tanpa izin darinya. Rumusan masalah yang diangkat dalam tesis ini yaitu faktor apakah yang dapat menyebabkan terjadinya penerbitan sertipikat yang tumpang tindih dan bagaimana solusi untuk mencegahnya serta bagaimana penerapan asas publikasi negatif tendensi positif dalam penerbitan sertipikat hak atas tanah oleh Badan Pertanahan Nasional sehingga terjadi tumpang tindih sertipikat.Metode Penelitian yang digunakan dalam tesis ini adalah metode yuridis normatif. Hasil penelitian ini adalah bahwa dalam terjadinya tumpang tindih seripikat berdasarkan beberapa faktor yang terutama adalah tidak sempurnanya peta pendaftaran terutama bagi daerah-daerah yang mengalami pemekaran wilayah, serta tidak telitinya para petugas/pejabat pertanahan dalam menjalankan tugas memeriksa data terkait kegiatan pendaftaran. Oleh sebab itu sebaiknya dikemudian hari pemerintah harus dapat mengatasi faktor-faktor tersebut yaitu agar menyempurnakan peta pendaftaran tanah yang ada serta meningkatkan mutu dan kedisiplinan serta ketelitian dari para petugas/pejabat kantor pertanahan. The formulation of the issues raised in this thesis is the factor that can lead to the issuance of the overlapped certificates and how the solution made to prevent it, and how the application of the principle of positive tendencies of negative publicity in the issuance of certificates of land rights by the National Land Agency which caused some overlap certificate. Research methods used in this thesis is the normative method. The results of this research are that in cases of overlapping certificates are based on several factors that primarily is incomplete map of enrollment, especially in regions that experiencing regional growth, and the carelessness of the officers officials of land offices in carry out the task of checking the data related to the registration activities. Therefore, we recommend in the future the government must be able to eliminate these factors by means of enhance existing land registration maps and improve the quality, discipline and thoroughness of the officers officials of the land office.
