ABSTRAK Tesis ini menganalisis alasan-alasan yang melatarbelakangi perubahan tren, implikasi pajak penghasilan bagi karyawan dan perusahaan afiliasinya di Indonesia serta dengan permasalahan yang dapat timbul dari pemberian kedua jenis kompensasi tersebut. Penelitian ini menggunakan metode kualitatif deskriptif. Hasil penelitian menyarankan bahwa pemilihan jenis kompensasi lintas batas cross border hendaknya juga mempertimbangkan analisa implikasi pajak di negara lain, sehingga dapat dihasilkan rencana bisnis menyeluruh yang tidak hanya memberikan keuntungan bagi perusahaan namun juga tidak memberikan tambahan beban bagi karyawan. Hasil penelitian juga menyarankan Pemerintah Indonesia, khususnya Direktorat Jenderal Pajak, untuk lebih bersikap proaktif dalam mengantisipasi permasalahan dengan merumuskan aturan dan kebijakan khusus. ABSTRACT This thesis analyzes the reasons that cause the trend changing, the Indonesia income tax implication for the employee and its affiliated company in Indonesia, also the issues that may rise on that both of share based compensation program. This research employs a qualitative descriptive method. It suggests that when deciding the cross border employee share based plan, the company should consider the income tax implication in the other countries as well therefore it results in a comprehensive business strategy that is not only favorable for business perspective but also not giving additional burden for the employee itself. It also urges the Indonesian Government, especially Director General of Taxation, to be more proactive in anticipating the issue by formulating a specific regulation and policy. |
