ABSTRAKPekerja merupakan pemegang peranan kunci dalam membina hubungan industrial yang harmonis demi menuju pembangunan suatu bangsa. Pemerintah menerbitkan berbagai peraturan yang ditujukan bagi perlindungan hak pekerja sebagai bentuk penghargaan bagi jasa pekerja. Salah satu hak yang sering diperjuangkan oleh pekerja adalah upah. Upah dianggap menjadi salah satu indikator tingkat kesejahteraan buruh akan terjamin. Perumusan upah minimum sebelum tahun 2015, masih melibatkan unsur pekerja, pengusaha, dan Pemerintah yang tergabung dalam Dewan Pengupahan. Namun pada tahun 2017, Pemerintah Provinsi DKI Jakarta menggunakan formula yang telah tercantum pada PP No 78 tahun 2015 dan tidak lagi mempertimbangkan hasil rekomendasi dari Dewan Pengupahan. Hal tersebut kemudian yang mendasari pekerja untuk melakukan gugatan melalui Gerakan Buruh Jakarta terhadap putusan Upah Minimum Provinsi UMP DKI Jakarta tahun 2017. Skripsi ini membahas tentang perumusan UMP DKI Jakarta tahun 2017, penjabaran kasus gugatan pekerja, dan bagaimana pemenuhan hak pekerja yang dilakukan oleh Pemerintah, pekerja, dan pengusaha, serta dilengkapi dengan rekomendasi pihak-pihak terkait. Penelitian ini adalah penelitian kualitatif dengan jenis penelitian deksriptif. Hasil penelitian menunjukkan adanya hubungan diantara ketiga aktor terkait didalam penetapan UMP DKI Jakarta 2017 dalam pemenuhan hak pekerja. Di sisi lain, ditemukan juga bahwa melalui penggunaan PP 78 tahun 2015 dalam perumusan UMP DKI Jakarta tahun 2017, hak pekerja untuk melakukan rekomendasi menjadi hilang. ABSTRACTWorkers are holding the key role in achieving the harmonious industrial relations in order to achieve the development of a nation. Government issued various regulations to protect the workers rsquo right as a form of respect for the services of workers. One of the workers rsquo right that often being fought for is wages. Wages are considered to be one of many indicators of the workers rsquo level of welfare will be guaranteed. The formulation of minimum wage in provinces before 2015, still include the workers, entrepreneurs, and Government itself who are gathered in Provincial Wage Council. However since 2017, the local Government of DKI Jakarta used Government Regulation No. 78 of 2015 on Wages and no longer considered the recommendations from the Provincial Wage Council. This resulted a lawsuit from workers through Gerakan Buruh Jakarta GBJ against the 2017 Jakarta Province Minimum Wage Decision UMP . The research of this study discusses the formulation of the 2017 Jakarta Province Minimum Wage Decision, the elaboration of the case, and how to analyze the relations of the three involved actors in fulfilling the workers rsquo right. The method of this study is qualitative research with descriptive design. The result of this study shows that there are relations between the three actors in fulfilling the workers rsquo right. On the other hand, it was also found that through the using of Government Regulation No. 78 of 2015 in the formulation of 2017 Jakarta Province Minimum Wage, there was an eliminating process of the workers rsquo right |
