ABSTRAK
Munculnya inovasi transportasi menggunakan sistem online memberikan berbagai reaksi di masyarakat, baik pro ataupun kontra. Dukungan diberikan oleh masyarakat dengan anggapan bahwa keberadaan taksi online memberikan kemudahan, sedangkan kontra muncul karena adanya kecemburuan sosial antara pengemudi taksi online dengan taksi konvensional akibat tidak adanya hukum terkait taksi online. Pada akhirnya, pemerintah membuat kebijakan untuk memberikan hukum bagi keduanya, akan tetapi, terdapat penolakan dari beberapa aktor yang mendorong pemerintah untuk membuat formula baru terkait kebijakan ini, namun, kebijakan baru yang diberikan tidak dapat menyelesaikan penolakan dan masalah yang ada pada kebijakan sebelumnya. Skripsi ini membahas bagaimanakah formulasi peraturan menteri No 26 Tahun 2017 tentang Angkutan Orang dengan Kendaraan Bermotor Umum Tidak Dalam TrayekS. Kemudian masalah tersebut dibahas menggunakan teori Sidney 2007 yang membagi tahap tersebut menjadi dua dimensi, dimensi identifikasi masalah dan dimensi pemilihan instrumen, menggunakan metode post-positivist dan analisis perbandingan dengan tipe ideal. Hasil penelitian menunjukkan bahwa proses formulasi Peraturan Menteri Perhubungan masih belum baik, hal ini dikarenakan masih kurangnya beberapa kajian yang harus dilakukan Kementerian Perhubungan, seperti, cost benefit analysis, perhitungan output dari instrumen, dan masih kurangnya perbandingan dengan nilai-nilai masyarakat serta perbandingan dengan negara berkembang lainnya yang telah berhasil memilih alternatif pada masalah yang serupa, selain itu waktu perumusan alternatif dan pemilihannya dilakukan dengan sangat singkat, hal ini mempengaruhi kualitas dari peraturan yang dibuat.
ABSTRACT
The emergence of transportation innovations using the online system provides various reactions in the community, whether pro or contra. Support is provided by the public with the assumption that the existence of an online taxi provides convenience, while the cons arise due to social jealousy between the online taxi drivers by conventional taxis due to the absence of a tax related online law. In the end, the government made a policy to give the law to both, however, there was resistance from some actors who encouraged the government to create a new formula related to this policy, however, the new policy given could not solve the rejection and problems that existed in the previous policy. This thesis discusses how the formulation of ministerial regulation of transportation No. 26 of 2017 about Public Transport which is Not In Route. Then the problem is discussed using the theory of Sidney 2007 which divides the stage into two dimensions, problem identification dimension and instrument selection dimension, using post positivist method and comparison analysis with ideal type. The result of the research shows that the process of formulation of the Minister of Transportation Regulation is still not good, because there are still some studies that need to be done by the Ministry of Transportation, such as cost benefit analysis, calculation of output from instrument, and still lack of comparison with community values and comparison with state other developers who have succeeded in choosing alternatives on similar issues, other than that the time of alternative formulation and the selection is done very briefly, it affects the quality of the rules created. |
