ABSTRAK Skripsi ini membahas mengenai pembuktian sederhana dalam kepailitan yang terdapat dalam pasal 8 ayat 4 UUK-PKPU serta penerapannya dikaitkan dengan prinsip utang dan hubungan hukum antara kreditor dan debitor pada putusan Pengadilan Niaga Nomor 18/Pailit/2012/PN.Niaga.Jkt.Pst. Utang merupakan dasar untuk mengajukan permohonan pernyataan pailit dan utang tersebut harus dapat dibuktikan secara sederhana. Dalam penelitian ini penulis mengajukan pokok permasalahan, yaitu 1 Apakah majelis hakim dalam putusan Pengadilan Niaga Nomor 18/Pailit/2012/PN.Niaga.Jkt.Pst telah sesuai menerapan pembuktian sederhana menurut pasal 8 ayat 4 UUK-PKPU? dan 2 Bagaimana penerapan prinsip utang dan hubungan hukum antara debitor dan kreditor dikaitkan dengan pembuktian sederhana menurut pasal 8 ayat 4 UUK-PKPU pada putusan Pengadilan Niaga Nomor 18/Pailit/2012/PN.Niaga.Jkt.Pst?. Penelitian ini menggunakan metode penelitian yuridis normatif dengan tipe penelitian deskriptif dan mono disipliner. Berdasarkan hasil analisa penulis, diperoleh kesimpulan bahwa, majelis hakim telah sesuai menerapkan pembuktian sederhana dalam pasal 8 ayat 4 UUK-PKPU dan juga telah sesuai menerapkan prinsip utang dikaitkan dengan pembuktian sederhana tersebut. Oleh sebab itu, putusan majelis hakim yang menolak permohonan pernyataan pailit yang diajukan oleh Para Pemohon dalam kasus tersebut sudah sesuai dengan UUK-PKPU." ""ABSTRACT "he focus of this thesis is on the simple justification in bankruptcy contain in Article 8 paragraph 4 UUK PKPU and its application related to the principle of debt and the legal relationship between creditors and debtor in the decision of Commercial Court Number 18 Pailit 2012 PN.Niaga.Jkt.Pst. Debt is the basis for filling petition for a declaration of a bankcruptcy and in bankruptcy that debt must be proven simply. In this study the writer proposed the main issues, which are 1 Are the panel of judges in the decision on Commercial Court Number 18 Pailit 2012 PN.Niaga.Jkt.Pst has been consistent to implement the simple justification accrording to Article 8 paragraph 4 UUK PKPU and 2 How the application of the principle of debt and the legal relationship between creditor and debtor associated to the simple justification according to Article 8 paragraph 4 UUK PKPU in the decision on Commercial Court Number 18 Pailit 2012 PN.Niaga.Jkt.Pst . This research used normative juridical method with a descriptive and mono dicipliner tipology. Based on the results of the writer rsquo s analysis, the writer came to conclusion that the panel of judges has been consistent to apply the simple justification in Article 8 paragraph 4 UUK PKPU and also has consistent apllying the principle of debt associated with simple justification. Therefore, the decision of the panel of the judges who refused the petition for a declaration of a bankcruptcy filled by the Petitiones in cases accordance with the UUK PKPU. |
