ABSTRACT<>br>In line with physical development that being speeded up by the government, Indonesia currently welcoming a huge number of foreign construction company that wants to make contract and do business on the country. At the beginning of 2017, Indonesian government regulated a new construction law named Act No. 2 2017, replacing Act No. 18 1999. Therefore in this article, the authors want to discuss about how the forementioned law Act. No.2 2017 ruling about construction contract that involving foreign contractor and then do a case study of Emrail Sdn Bhd Malaysian company on LRT Jakarta Trackworks construction contract. After the research, the author concludes that Act born constituting new norms that ruling about foreign contractor which can rsquo t be found on old construction law. However, in the practice, those new norms hasnt been fully obeyed, one of them is Emrail Sdn Bhd which breaking some rules about representative office and license Izin Perwakilan . That problem gives legal consequences to the enterprise administratively and to the LRT Jakarta Trackworks construction contract it made.
