Penetapan wasiat yang dibuat oleh Notaris berdasarkan kehendak pewaris memiliki batasan-batasan terhadap ahli waris mutlak yang ditentukan secara undang-undang tidak boleh terlanggar haknya. Hal ini ditetapkan dalam Pasal 913 Kitab Undang-Undang Hukum Perdata. Permasalahan yang dibahas dalam Tesis ini adalah 1 Bagaimana akibat hukum atas isi akta wasiat yang dibuat oleh Notaris FM yang tidak sesuai dengan ketentuan Legitieme Portie hukum waris perdata di Indonesia? 2 Bagaimana pelaksanaan pembagian waris terhadap isi akta wasiat nomor 103 yang dibuat oleh Notaris FM dikaitkan dengan subjek dan objek waris di dalam negeri dan luar negeri? Penulisan Tesis ini menggunakan metode penelitian hukum Yuridis-Normatif, penelitian kepustakaan mengenai Akta Wasiat Nomor 103 yang dibuat oleh Notaris FM berdasarkan Kitab Undang-Undang Hukum Perdata, serta diperkuat dengan hasil kepustakaan yang berasal dari narasumber dengan wawancara. Akta wasiat yang diteliti tersebut tidak sesuai dengan legitieme portie dan memberikan 2 dua akibat hukum, yaitu: apabila ahli waris ab instestato LP tidak menyetujui atas isi wasiat itu, mereka dapat menutuntut ke Pengadilan Negeri. Apabila ahli waris ab intestato LP tersebut menyetujui isi wasiat itu, wasiat itu dapat dilaksanakan. Pelaksanaan wasiat tersebut dilakukan dengan pembagian atas harta peninggalan di Wilayah Republik Indonesia kepada ahli waris Warga Negara Indonesia dan atas harta peninggalan di luar Wilayah Republik Indonesia kepada ahli waris Warga Negara Asing secara proposional sesuai bagiannya.Kata Kunci: Notaris, Akta Wasiat, Pewarisan, Pewaris dan Ahli Waris, Legitimasi Portie, Subjek dan Objek Waris, Warga Negara Indonesia, Warga Negara Asing.
In determination of will made by the Notary based on the will of the heir has the limitations of Ab Intestato Legitimacy Portie heirs which their rights shall not be violated. This is stipulated in Article 913 of the Civil Code. The issues discussed in this thesis are 1 How the legal consequences of the contents of the will made by Notary FM which is not in accordance with Legitimacy Portie in Indonesian Civil Code 2 How the implementation of division of inheritance to the contents of the will number 103 made by Notary FM relating to the subjects and objects of inheritance within the country and abroad This thesis writing uses the Juridical Normative law research method, a library research on Wills Number 103 Made by Notary FM based on the Civil Code, and also reinforced with the results of the literature from interview with intervieweers. The investigated of this deed of will does not conform to the legitimacy portie and gives 2 two legal consequences if the Ab Intestato Legitimacy Portie heirs does not agree on the content of the will, they can claim to the District Court. But if Ab Intestato Legitimacy Portie heirs agrees on the contents of the will, the will can be executed.
