Undang-Undang Nomor 17 Tahun 2012 Tentang Perkoperasian sudah tidak mempunyai kekuatan hukum mengikat karena telah bertentangan dengan Pasal 33 ayat (1) Undang-Undang Dasar 1945 dan dicabut melalui Putusan Nomor 28/PUUXI/2013, maka Mahkamah Konstitusi memberlakukan kembali Undang-Undang Nomor 25 tahun 1992 untuk sementara waktu. Dari latar belakang tersebut terdapat beberapa pokok permasalahan, yaitu peran notaris terhadap pembuatan akta koperasi pasca pencabutan Undang-Undang Nomor 17 Tahun 2012 Tentang Perkoperasian, akibat hukum bagi peran notaris terhadap pembuatan akta koperasi, serta implementasi tentang pendaftaran akta koperasi secara online berdasarkan Peraturan Menteri Koperasi dan Usaha Kecil dan Menengah Republik Indonesia Nomor 10/PER/M.KUKM/IX/2015 Tentang Kelembagaan Koperasi. Penelitian ini merupakan penelitian yuridis normatif yang bersifat deskriptif analitis dengan metode kualitatif.Hasil penelitian ini antara lain adalah peran notaris harus tetap dibuat akta otentik oleh notaris dengan mengacu pada Keputusan Menteri Koperasi dan Usaha Kecil dan Menengah Nomor 98/KEP/M.KUKM/IX/2004 Tentang Notaris Sebagai Pembuat Akta Koperasi. akibat hukum bagi peran notaris pasca pencabutan Undang-Undang Nomor 17 Tahun 2012 Tentang Perkoperasian adalah tidak mempengaruhi peran notaris itu sendiri karena walaupun Undang-Undang Nomor 25 Tahun 1992 tidak mensyaratkan akta koperasi harus dibuat dengan akta otentik, tapi harus sudah menjadi kebiasaan. SISMINBHKOP masih mengalami kendala, seperti ketidaksiapan pemerintah dikarenakan masih banyak proses-proses pengesahan yang dilakukan secara manual. Law No. 17 of 2012 on Cooperatives has no binding legal force because it is contradictory to Article 33 Paragraph (1) of the 1945 Constitution and is revoked through Decision Number 28 / PUU-XI / 2013, therefore the Constitutional Court reOf Law Number 25 of 1992 for the time being. From the background there are several issues, namely the role of notary to the making of the deed of cooperatives after the revocation of Law No. 17 of 2012 on Cooperatives, the legal consequences for the role of notary to the making of the cooperative deed, as well as the implementation of registration of the cooperative certificate online based on the Regulation of the Minister of Cooperatives and Small and Medium Enterprises of the Republic of Indonesia Number 10 / PER / M.KUKM / IX / 2015 About Institutional Cooperatives. This research is a normative juridical research that is analytical descriptive with qualitative method. The results of this research are, among other things, the role of a notary must be made authentic deed by a notary by referring to the Minister of Cooperatives and Small and Medium Enterprises Decree Number 98 / KEP / M.KUKM / IX / 2004 Notary as the Deed Maker of Cooperation. the legal consequences for the role of the notary after the revocation of Law No. 17 of 2012 on Cooperatives are not affecting the role of the notary itself because although Law Number 25 Year 1992 does not require a cooperative deed to be made by an authentic deed, it must become a habit. SISMINBHKOP is still experiencing obstacles, such as government unpreparedness because there are still many legal processes that are done manually. |
