ABSTRAK Studi skripsi ini membahas tentang fatwa yang dikeluarkanoleh Majelis Ulama Indonesia (MUI) tentang aliran pemikiran Syiah. Penelitian inimenggunakan teori maqāṣid syarī'ah yang dirumuskan oleh Jasser Audadalam mengeksplorasi masalah-masalah yang terkandung dalam fatwa MUI tentang Syiah.Maqāṣid syarī'ah yang diformulasikan oleh Jasser Auda bukanlah suatu halyang baru. Jasser Auda merekonstruksi maqāṣid syarī'ahmelalui integrasi antara ushul fiqh dengan teori sistem. Rekonstruksikemudian menghasilkan enam prinsip yang harus dipertimbangkan untuk hukumIslam dapat menekankan sisi maqāṣid syarī'ah. Keenam prinsip ituadalah hirarki kognitif, holistik, berpikiran terbuka, saling terkait,multidimensi dan bermakna. Belajar melalui maqāṣid syarī'ahmenunjukkan bahwa fatwa MUI tentang Syiah sedang berlangsungtahap epistemologi. Epistemologi berkaitan dengan fundamentalpenetapan fatwa MUI, yaitu sumber hukum dan metode penentuan fatwa.Masalahnya adalah bahwa MUI cenderung menggunakan sudut pandangyang madhhab-sentris, sudut pandang yang hanya merujukdi satu sekolah tertentu. Hasil penelitian ini menunjukkan bahwamaqāṣid syarī'ah tidak hanya berperan dalam pemeriksaan, tetapi jugaberperan penting dalam merekonstruksi penentuan dasar fatwa MUI tentang Syiah. ABSTRACT his thesis study discusses about the fatwa issuedby the Indonesian Ulema Council (MUI) on the flow of Shia thought. This researchusing the maqāṣid syarī'ah theory formulated by Jasser Audain exploring the issues contained in the MUI fatwa on Shias.Maqāṣid syarī'ah formulated by Jasser Auda is not a thingthe new one. Jasser Auda reconstructed maqāṣid syarī'ahthrough integration between ushul fiqh with system theory. Reconstructionthen produce six principles that must be considered for the lawIslam can emphasize the maqāṣid syarī'ah side. The six principlesis a cognitive, holistic, open-minded, interrelated hierarchy,multidimensional and meaningful. Learn through maqāṣid syarī'ahshows that the MUI fatwa issue about Shias is ongoingepistemology stage. Epistemology deals with the fundamentalsthe determination of the MUI fatwa, namely the source of the law and the method of determining the fatwa.The problem is that MUI tend to use the point of viewthe madhhab-centric, point of view that simply refersin one particular school. The results of this study indicate thatmaqāṣid syarī'ah not only plays a role in checking, but alsowas instrumental in reconstructing the basic determinations of MUI's fatwa on Shias. |
