ABSTRACT
Dalam penelitian ini, penulis mencoba melihat dampak efek general deterrence yang dihasilkan oleh Operasi Tangkap Tangan OTT Satuan Tugas Sapu Bersih Pungutan Liar Satgas Saber Pungli sebagai sebuah lembaga hukum yang baru diresmikan pada tahun 2016. Kemudian, penulis mengaitkan dampak tersebut terhadap tingkat risiko pegawai kantor kelurahan di Kota Depok melakukan pungutan liar. Untuk melihat tingkat efek general deterrence penulis menggunakan tujuh elemen deterrence dari Stafford dan Warr Sitren, 2007 yaitu kepastian hukuman, keseriusan hukuman, pengalaman orang lain, keuntungan dan kerugian, impulsivitas, dan keagamaan. Kemudian, dalam melihat tingkat risiko pelanggaran, penulis meminjam elemen-elemen dari teori routine activities yaitu pelaku yang termotivasi motivated offender, target yang cocok suitable target dan tidak adanya penjagaan yang mumpuni absence of a capable guardian . Hasil olah data dari kuesioner yang disebarkan ke 152 responden menyatakan bahwa semakin tinggi efek general deterrence OTT Satgas Saber Pungli, maka semakin rendah risiko pelanggaran pegawai kantor kelurahan di Kota Depok.
ABSTRACT
In this research, the author tried to see the impact deterrence effect generated by the Operasi Tangkap Tangan OTT or apprehension by The Sapu Bersih Pungutan Liar Task Force Saber Pungli Task Force as a new legal institution officially established in 2016. Afterwards, the author linked the impact to the risk level of violation illegal levies by urban village officer in Depok City. To see the general deterrence level the author used seven elements from Stafford and War Sitren, 2007, namely certainty of punishment severity of punishment the experience of others costs and benefits impulsivity, and religiosity. Then, in the variable of violation risk, the author used elements of the routine activities theory namely motivated offender, suitable targets and absence of capable guardians. The results of this research from the questionnaires distributed to 152 respondents stated that the higher the general deterrence level of OTT by Saber Pungli Task Force, the lower the violation risk of the urban village officer in Depok City. |
