ABSTRACT Skripsi ini merupakan penelitian yang ditujukan untuk membahas The Surrogacy Regulation Bill sebagai upaya Pemerintah India mengurangi eksploitasi kaum perempuan miskin dalam praktik commercial surrogacy tahun 2016. Penelitian ini berupaya untuk mengkaji faktor-faktor apa yang mempengaruhi Pemerintah India dalam mengeluarkan regulasi tersebut pada tahun 2016, di mana praktik commercial surrogacy semakin berkembang pesat di India dan terdapat fenomena eksploitasi kaum perempuan miskin yang berprofesi sebagai ibu pengganti. Dalam penelitian ini penulis menggunakan konsep budaya patriarki untuk mengkaji permasalahan mengenai tubuh kaum perempuan miskin yang berada di wilayah privat Kemudian, pada penelitian ini menggunakan teori Agenda Setting untuk mengkaji lebih dalam terkait perjalanan politik terciptanya The Surrogacy Regulation Bill tahun 2016 yang bermula dari sebuah isu kebijakan masuk ke agenda setting pemerintah. Kemunculan The Surrogacy Regulation Bill tahun 2016 ini telah melibatkan peranan dari Kabinet Union, Lok Sabha, Rajya Sabha, beberapa kelompok kepentingan, gerakan protes dari Stop Surrogacy Now dan perhatian media. ABSTRACT This thesis focuses on The Surrogacy Regulation Bill as an effort by the Government of India to reduce the exploitation of poor women in the practice of commercial surrogacy in 2016. This research seeks to examine factors that influence Government of India rsquo s ratification of the regulation in 2016, as the number of commercial surrogacy has grown exponentially in India. Additionally, there is also a major phenomenon of exploitation of poor women who work as surrogate mothers. In this study, the author uses concepts of Patriarchal Culture to examine the issues concerning the lives of poor women who reside in private territory and are influenced heavily by the patriarchal culture in Indian society. Then, this thesis implements the Agenda Setting theory for deeper examination related to the process of The Surrogacy Regulation Bill 2016 which started from a policy issue into the agenda of government setting. The appearance of The Surrogacy Regulation Bill of 2016 has involved the role of the Union Cabinet, Lok Sabha, Rajya Sabha, stakeholders, the movement called lsquo Stop Surrogacy Now rsquo and the media influence. |
